USE OF ADVISORY MATERIAL ON WET OR CONTAMINATED RUNWAYS
I, MICHAEL ROBERT TOLLER, Director of Aviation Safety, on behalf of CASA:
(1) under subregulation 235 (2) of the Civil Aviation Regulations 1988 (the Regulations), issue the directions set out in Schedule 1 for determining a maximum weight that the gross weight of an aircraft with an MTOW of more than 5700 kg that is employed in regular public transport operations must not exceed at take-off or landing on a wet or contaminated runway; and
(2) under regulation 308 of the Regulations, having taken into account all relevant considerations relating to the interests of safety, issue the following exemptions, subject to the conditions set out in Schedule 2:
(a) the operator of an aircraft referred to in paragraph (1) is exempt from compliance with subregulation 215 (2) of the Regulations;
(b) a member of the operations personnel of the operator of an aircraft referred to in paragraph (1) is exempt from compliance with subregulation 215 (9) of the Regulations;
(c) the pilot in command of an aircraft referred to in paragraph (1) is exempt from compliance with regulation 138 of the Regulations.
SCHEDULE 1
DIRECTIONS
1. In this Schedule:
approved means approved by an officer who is a delegate for the purposes of subregulation 215 (3) of the Regulations.
contaminated runway means a runway that has more than 25% of its surface area within the length and width being used, whether in isolated areas or not, covered by any of the following:
(a) surface water more than 3 mm deep, or slush or loose snow equivalent to more than 3 mm of water;
(b) compacted snow (snow that has been compressed into a solid that resists further compression and holds together or breaks into lumps if picked up);
(c) ice, including wet ice.
V1 (wet) means a reduced V1 (take-off decision speed) established for use on a wet or contaminated runway.
wet runway means a runway that:
(a) is covered by surface water not more than 3mm deep, or by slush or loose snow equivalent to surface water not more than 3 mm deep; or
(b) has sufficient moisture on the surface to cause it to appear reflective, but without significant areas of standing water.
2. In the case of a wet or contaminated runway, the operator or pilot in command of an aircraft to which this exemption applies may calculate the accelerate-stop and take-off distances (otherwise required to be established in accordance with paragraph 6.1 or 6.2 of section 20.7.1B of the Civil Aviation Orders) by the application instead of data relating to the use of a V1 (wet), set out in:
(a) the manufacturer’s data manual; or
(b) an approved foreign flight manual for the aircraft;
to the extent that its use has been approved for that purpose.
3. An operator or pilot in command must not use a V1 (wet) unless it complies with the following requirements:
(a) it must be less than the V1 (take-off decision speed) appropriate to a dry runway but not less than the minimum control speed on the ground (Vmcg );
(b) in the event of an engine failure recognised at V1 (wet), the lowest point on the aeroplane will be at a height no less than 15 feet above the ground at the end of the runway or the clearway, whichever is applicable.
4. In the case of a wet or contaminated runway, the operator or pilot in command of an aircraft to which this exemption applies may calculate a landing distance (otherwise required to be established under paragraph 11.1 of section 20.7.1B), by the application instead of data set out in:
(a) the manufacturer’s data manual; or
(b) an approved foreign flight manual for the aircraft;
to the extent that its use has been approved for that purpose.
5. On a wet or contaminated runway, the take-off weight must not exceed that permitted for take-off on a dry runway under the same conditions of pressure altitude and ambient temperature.
6. These directions modify directions set out in subsections 4, 5, 6 and 11 of section 20.7.1B, and in particular provide that:
(a) accelerate-stop and take-off distances established under this exemption may be used under subparagraph 4.1 (a) of section 20.7.1B as if established in accordance with subsection 6 of section 20.7.1B; and
(b) required landing distances established in accordance with this exemption may be used under subparagraph 5.1 (a) as if established in accordance with subsection 11 of section 20.7.1B.
SCHEDULE 2
CONDITIONS OF EXEMPTION
1. In spite of subregulation 215 (2) of the Regulations, the operator of an aircraft to which this exemption applies, unless directed to do so under subregulation 215 (3) of the Regulations, is not required to include, in an operations manual, information, procedures and instructions relating to the use of a V1 (wet), or the calculation of a required landing distance, under this instrument.
2. In spite of subregulation 215 (9) of the Regulations, each member of the operations personnel of an operator to whom this exemption applies is not required to comply with the instructions contained in an operations manual to the extent that they are inconsistent with the use of a V1 (wet), or the calculation of a required landing distance, under this instrument. Each member may instead comply with:
(a) the manufacturer’s data manual; or
(b) an approved foreign flight manual for the aircraft;
to the extent that its use has been approved for that purpose under this instrument.
3. Each pilot in command of an aircraft to which this exemption applies is not required to comply with a requirement, procedure, instruction or limitation referred to in regulation 138, to the extent that it is inconsistent with the use of a V1 (wet) under this exemption. Each pilot in command may instead comply with:
(a) the manufacturer’s data manual; or
(b) an approved foreign flight manual for the aircraft;
to the extent that its use is approved under this instrument.
This exemption ceases to have effect at the end of July 2005.
