Exemption — minimum height and lateral separation for operations (Aerotech First Response)

1          Duration

                 This instrument:

(a)   commences on the day of registration; and

(b)   expires at the end of November 2018, as if it had been repealed by another instrument.

2          Repeal

                 Instrument CASA EX179/12 is repealed.

3          Application

                 This instrument applies to the pilot in command of an aeroplane operated by Aerotech First Response Pty Ltd, Aviation Reference Number 525279 (the operator), engaged in:

(a)   operations involving the dropping of fire retardant, foam or water for fire fighting; or

(b)   reconnaissance flights undertaken for fire fighting.

4          Exemptions

                 A pilot in command mentioned in section 3 is exempt from:

(a) the requirements of subregulation 137.140 (3) of CASR 1998 to the extent mentioned in Schedule 1; and

(b)   the requirements of subregulation 137.140 (4).

5          Condition

                 The exemptions are subject to the condition mentioned in Schedule 2.

Schedule 1          Extent of exemption

              The exemption against the requirements of subregulation 137.140 (3) applies only when an aeroplane is required to drop fire retardant over an occupied building or over an area adjacent to an occupied building.

Schedule 2          Condition

               The operation must be conducted under an arrangement with a recognised State or Territory emergency services authority.
