Exemption — requirement for grant of special certificate of airworthiness for a light sport aircraft (ICON A5)
1 Duration
This instrument:
(a) commences on the day of registration; and
(b) expires at the end of June 2018, as if it had been repealed by another instrument.
2 Definitions
In this instrument:
light sport aircraft has the same meaning given in Part 1 of the Dictionary to CASR 1998.
MTOW means maximum take-off weight.
3 Application
This instrument applies to a person (the applicant) who:
(a) is the registration holder or owner of an ICON A5 aircraft; and
(b) is not entitled to apply for a special certificate of airworthiness for a light sport aircraft under regulation 21.186 of CASR 1998 because the aircraft does not satisfy the definition of light sport aircraft.
4 Exemption
The applicant is exempt from compliance with paragraph 21.176 (1) (c) of CASR 1998, but only in relation to subregulation 21.186 (1) to the extent that the ICON A5 aircraft does not satisfy the definition of light sport aircraft in relation to subparagraph (a) (ii) of that definition in relation to MTOW.
Note 1 Subregulation 21.176 (1) requires CASA or an authorised person to issue a certificate of airworthiness to an applicant for the certificate if the applicant is, amongst other requirements, under paragraph (c), entitled under Subpart 21.H to the certificate.
Note 2 Under Subpart 21.H of CASR 1998,subregulation 21.186 (1) states that an applicant is entitled to a special certificate of airworthiness for a light sport aircraft if the requirements set out in that subregulation have been met. This includes the requirement that, under subparagraph (b) (iii), written information be provided showing that the aircraft is eligible for a certificate of airworthiness or another document of similar effect in the country of manufacture.
5 Conditions
The exemption is subject to the conditions set out in Schedule 1.
Schedule 1 Conditions
1 The applicant must ensure that the ICON A5 aircraft meets the eligibility requirements for the grant of a special certificate of airworthiness for a light sport aircraft, other than the requirement for the aircraft to have a MTOW mentioned in subparagraph (a) (ii) of the definition of light sport aircraft.
2 The applicant must provide evidence that the aircraft was manufactured in accordance with the requirements of FAA Exemption No. 10829.
3 The applicant must ensure that the aircraft is maintained and operated as if it were a light sport aircraft.
