Exemption — carriage of children suffering from a serious medical condition (Virgin Australia)

1          Duration

                 This instrument:

(a)   commences on the day of registration; and

(b)   expires at the end of October 2018, as if it had been repealed by another instrument.

2          Repeal

                 Instrument CASA EX46/14 is repealed.

3          Application

   This instrument applies to Virgin Australia Airlines Pty Ltd, Aviation Reference Number 567591 (the operator), in relation to the carriage of a child over 2 years old who:

(a)   suffers from a serious medical condition which makes it impossible for him or her to sit upright unaided; and

(b)   weighs less than 16 kilograms.

4          Exemption

        The operator and a child to whom this instrument applies are exempt from compliance with subregulation 251 (1) of the Civil Aviation Regulations 1988.

5          Conditions

                 The exemption is subject to the conditions mentioned in Schedule 1.

Schedule 1          Conditions

        1     The operator may only carry a child to whom this instrument applies:

(a)   on aircraft operated by the operator; and

(b)   in accordance with the operator’s operations manual.

        2     The operator must ensure that all staff who may reasonably be expected to have any contact with the child during flight must be informed about carriage of the child under this exemption and the child’s medical condition.

        3     The operator must ensure that a qualified medical practitioner has provided a statement in writing that mentions the child’s medical condition, and that the child:

(a)   is unable to sit upright unaided; and

(b)   weighs under 16 kilograms; and

(c)   is fit to travel.

        4     The operator must ensure that an approved infant seat belt is used in the aircraft to restrain the child while sitting on an accompanying adult’s lap.

        5     A copy of this exemption must be included in the operator’s operations manual.
