Exemption — recency flying at night by holders of night V.F.R. agricultural ratings

1          Duration

                 This instrument:

(a)   commences on 1 March 2013; and

(b)   stops having effect at the end of February 2016.

2          Definitions

                 In this instrument:

AGL means above ground level.

agricultural pilot means the holder of a rating.

approved person means a person that is approved by CASA to determine the competency of a pilot to conduct agricultural operations at night.

Order means Civil Aviation Order 40.2.2.

rating means night V.F.R agricultural rating.

3          Application

                 This instrument applies to agricultural pilots who do not meet the requirements of subparagraph 5.1 (a) of Appendix II of the Order.

4          Exemption

                 Agricultural pilots are exempt from compliance with subparagraph 5.1 (a) of Appendix II of the Order.

5          Conditions

                 The exemption is subject to the conditions mentioned in Schedule 1.

Schedule 1          Conditions

        1     In the 12 months preceding the flight, the pilot must have either:

(a)   completed 10 hours of agricultural operations at night below 500 feet AGL; or

(b)   been assessed as competent to conduct agricultural operations at night by an approved person.

        2     The pilot may begin an agricultural operation below 500 feet AGL later than 20 minutes before night only if the pilot has, in the 45 days preceding the flight, either:

(a)   completed agricultural operations at night below 500 feet AGL, including at least 3 take-offs and 3 landings at night, in aircraft of the same category; or

(b)   practiced the necessary manoeuvres involved in agricultural operations in an unladen aircraft at night, including night circuits and simulated application runs along the runway lights or flare path.
