Exemption — from welding training for grant of aircraft welding authority

1          Duration

                 This instrument:

(a)   commences on the day after registration; and

(b)   expires at the end of September 2017, as if it had been repealed by another instrument.

2          Application

                 This instrument applies to a person (the applicant), in relation to the person’s application for an aircraft welding authority under regulation 33C of the Civil Aviation Regulations 1988 (CAR 1988) (the application) if:

(a)   before the date the applicant submitted the application to CASA, the applicant held an aircraft welding authority (the AWA); and

(b)   the AWA ceased to be in force within the 10 years before the date the applicant submitted the application to CASA; and

(c)   the AWA was not cancelled; and

(d)   the AWA was not suspended at the time it ceased to be in force; and

(e)   the applicant has submitted to CASA evidence that the applicant held the AWA and of the type of manual welding and parent metal group to which the AWA related immediately before it ceased to be in force.

Note   This instrument does not apply if the AWA was cancelled, or was suspended at the time it ceased to be in force.

3          Exemption

The applicant is exempt from compliance with subparagraph 33D (1) (a) (ii) of CAR 1988 in respect of the type of manual welding on the parent metal group to which the AWA related immediately before it ceased to be in force.

Note   Regulation 33D of CAR 1988 states that CASA may grant an aircraft welding authority if satisfied that the applicant has, as required by subparagraph 33D (1) (a) (ii), successfully completed welding training in the type of manual welding on the parent metal group to which the application relates.
