Exemption — flights by competitors of the Canungra Classic and Canungra Cup within controlled airspace
1 Duration
This instrument:
(a) commences on the day of registration; and
(b) is repealed at the end of 30 September 2020.
2 Definitions
In this instrument:
Note In this instrument certain terms and expressions have the same meaning as they have in the Civil Aviation Act 1988, the regulations, and Civil Aviation Order 95.8 Instrument 2011 (CAO 95.8). These include AA, HGFA and HGFA Operations Manual.
Competition Director means a person who:
(a) has been appointed to the role of Competition Director by a person or persons acting for, or on behalf of, the Competition Organiser; and
(b) is responsible on‑site for ensuring that a competition is conducted in accordance with the format and rules that have been determined by the Competition Organiser.
Competition Organiser means the Canungra Hang Gliding Club Inc.
competitions means the following competitions that are conducted by the Competition Organiser from Canungra, Queensland and in the airspace in the vicinity of Canungra:
(a) the annual hang-gliding competition known as the “Canungra Classic”; and
(b) the annual paragliding competition known as the “Canungra Cup”.
Note In 2017, the Canungra Classic and Canungra Cup will be held during the month of October. Each competition will be held over an 8‑day period.
declared areas means the areas of Australian territory mentioned in Schedule 1 if a declaration is in force under regulation 6 of the Airspace Regulations 2007 designating the areas to be a restricted area or a danger area.
HGFA membership means 1 of the following memberships with the HGFA as defined by the HGFA Operations Manual as it exists from time to time:
(a) Full Member;
(b) Life Member;
(c) Visiting Pilot Membership.
registered competitor means a person who:
(a) meets the requirements of the Competition Organiser for registration to compete in a competition; and
(b) has successfully registered their attendance and intention to compete in the competitions with the Competition Organiser.
relevant qualifications mean the following:
(a) for hang-gliding operations:
(i) a Supervised Pilot Certificate (as defined by the HGFA Operations Manual as it exists from time to time), and flight experience of a minimum of 25 hours’ air time in a hang-glider that, in the opinion of the Competition Organiser, is appropriate for participation in a competition; or
(ii) a higher qualification issued by the HGFA;
(b) for paragliding operations:
(i) a PG3 Pilot Certificate (as defined by the HGFA Operations Manual as it exists from time to time), and flight experience of a minimum of 50 hours’ air time in a paraglider that, in the opinion of the Competition Organiser, is appropriate for participation in a competition; or
(ii) a higher qualification issued by the HGFA;
(c) a valid overseas qualification and flight experience recognised by the HGFA as equivalent to, or higher than, the qualifications mentioned in paragraph (a) or (b).
3 Application
This instrument applies to a pilot of an aircraft to which CAO 95.8 applies, if the pilotconducts a flight in a declared area for the purpose of competing in a competition and:
(a) holds a current HGFA membership; and
(b) holds the relevant qualifications; and
(c) is a registered competitor; and
(d) before commencing the flight — has obtained a briefing from the Competition Director, or a nominee of the Competition Director:
(i) detailing the airspace restrictions and boundaries of each declared area applicable to the location of the flight; and
(ii) notifying the pilot that a letter of agreement is in place between the Competition Organiser and AA governing the management of airspace issues related to the competitions; and
(e) during the flight — carries a serviceable radio capable of transmitting on the ultra high frequency (UHF) radiofrequency and monitors the radiofrequency band designated for the flight by the Competition Director.
4 Exemptions
(1) For regulation 11.160 of CASR, the pilot is exempt from compliance with the following:
(a) subparagraph 7.3 (b) of CAO 95.8;
(b) paragraph 7.6 of CAO 95.8;
(c) subregulation 83 (1) of CAR.
(2) For regulation 11.205 of CASR, the exemptions are subject to the conditions mentioned in section 5.
5 Conditions
(1) The Competition Director must:
(a) ensure that a NOTAM has been published which correctly identifies the designation of the declared areas for the duration of the competitions; and
(b) at the commencement of a day in which flights for a competition are to be held, confirm with AA the availability of the declared areas to be used for the flights; and
(c) nominate a mobile telephone number that AA may use to contact the Competition Director during the period that the declared areas are in force; and
(d) notify AA as soon as possible once flights in the declared area are no longer required for that day of competition.
(2) The Competition Organiser must ensure that:
(a) the Competition Director complies with the requirements mentioned in subsection (1); and
(b) a person intending to compete in a competition fulfils the criteria mentioned in the paragraphs of section 3.
