CASA EX141/21 — Recording of Time-in-service (Class A Aircraft) Exemption 2021

1          Name

                 This instrument is CASA EX141/21 — Recording of Time-in-service (Class A Aircraft) Exemption 2021.

2          Duration

                 This instrument:

(a)   commences on 1 December 2021; and

(b)   is repealed at the end of 30 November 2024.

3          Definition

Note   In this instrument, certain terms and expressions have the same meaning as they have in the Civil Aviation Act 1988 and the regulations. These include class A aircraft and time‑in‑service.

                 In this instrument:

maintenance control manual has the same meaning as in regulation 42ZY of CAR.

4          Exemption

        (1)     The owner, the operator and the pilot in command of a class A aircraft are each exempt from compliance with subregulation 43B (1) of CAR in relation to the aircraft.

        (2)     The exemption is subject to the conditions in section 5.

5          Conditions

        (1)     The operator of the aircraft must include in the operator’s maintenance control manual, as in force from time to time, for the aircraft a procedure for how the operator will ensure:

(a)   the recording of time‑in‑service information that is necessary to meet continuing airworthiness requirements for the aircraft; and

(b)   that the record of the information mentioned in paragraph (a) is kept up to date.

        (2)     On the completion of flying operations on each day that the aircraft is flown, the operator of the aircraft must ensure that the time‑in‑service of the aircraft is recorded in accordance with the procedures mentioned in subsection (1).
