CASA EX14/1999 Exemption from paragraph 166(1)(c) of the Civil Aviation Regulations 1988 (Cth)

EXEMPTION FROM PARAGRAPH 166 (1) (C)
OF THE CIVIL AVIATION REGULATIONS 1988
I, MICHAEL ROBERT TOLLER, Director of Aviation Safety, acting under regulation 308 of the Civil Aviation Regulations 1988 and having taken into account all relevant considerations relating to the interests of safety:
(a)revoke exemptions numbered 07/1994, 08/1994, CASA 03/96 and CASA 06/97 respectively; and
(b)exempt the pilot in command of:
(i)a high capacity aircraft that is employed in regular public transport operations; or
(ii)an aircraft that is not a high capacity aircraft, but is required under subsection 8 of section 82.3 of the Civil Aviation Orders to be, and is, crewed by at least 2 pilots;
from compliance with paragraph 166 (1) (c) of those regulations while the aircraft is making a straight-in visual approach to a non-controlled aerodrome that has a CTAF/MBZ frequency for its terminal airspace.
The above exemption is subject to the pilot in command of the aircraft complying with the following conditions, which are necessary in the interests of safety:
(a)the pilot must ensure that the aircraft is equipped with a serviceable VHF radio operating on the CTAF/MBZ frequency for the terminal airspace of the aerodrome;
(b)the pilot must not, in relation to the straight-in approach, contravene:
(i)if the aircraft is a high capacity aircraft — sub-subparagraph 5B.1 (c), (d), (e), (f) or (g), or paragraph 5B.2, of section 82.5 of the Civil Aviation Orders; or
(ii)if the aircraft is not a high capacity aircraft — sub-subparagraph 5B.1 (c), (d), (e), (f) or (g), or paragraph 5B.2, of section 82.3 of the Civil Aviation Orders.
In this exemption:
CTAF/MBZ radio frequency, high capacity aircraft and non-controlled aerodrome each have the same meaning as they have in Part 82 of the Civil Aviation Orders.
This exemption comes into effect on
