Exemption — flight data recording

1          Duration

            This instrument:

(a)   commences on the day after it is registered; and

(b)   stops having effect at the end of 30 April 2007.

2          Application

            This instrument applies to the aircraft mentioned in Schedule 1 and operated by Private Air Pty Limited, Aviation Registration Number 576400 (the operator), and used in charter operations.

3          Exemption

The aircraft is exempt from compliance with subregulation 207 (2) of CAR 1988 only to the extent mentioned in Schedule 2.

4          Conditions

            The exemption is subject to the conditions mentioned in Schedule 3 which are necessary in the interests of safety.

Schedule 2          Extent of exemption

            The exemption extends only to the directions under subregulation 207 (2) that are contained in subparagraph 6.1 (a) of Civil Aviation Order 20.18.

Schedule 3          Conditions

      1       The operator of the aircraft must comply with the operating conditions of the operator’s Minimum Equipment List.

      2     The aircraft must be equipped with a serviceable cockpit voice recorder.

      3     A copy of the instrument must be carried on board the aircraft.

      4     A copy of the instrument must be kept in the permanent records of the aircraft.
