Exemption — requirements for helicopter aerial application endorsements

1          Duration

                 This instrument:

(a)   commences on the day after registration; and

(b)   is repealed at the end of 31 August 2019.

2          Definitions

                 In this instrument:

aerial application endorsement has the same meaning as in regulation 61.010 of CASR.

helicopter aerial application endorsement means the endorsement mentioned in item 2 of table 61.1120 of CASR.

3          Application

                 This instrument applies to a person if:

(a)   the person applies:

             (i)  under regulation 61.1115 of CASR for an aerial application rating based on meeting the requirements for the grant of a helicopter aerial application endorsement; or

            (ii)  under regulation 61.1140 of CASR for the grant of a helicopter aerial application endorsement; and

(b)   the person has at least 10 hours of dual flight in a helicopter while receiving training in aerial application operations.

4          Exemption

        (1)     For the purposes of paragraphs 61.1115 (1) (b) and 61.1140 (1) (b) of CASR, the person is exempt from compliance with the requirement mentioned in column 3 of item 2 of table 61.1120 of CASR to have at least 15 hours of dual flight in a helicopter while receiving training in aerial application operations.

        (2)     The exemption is subject to the condition in section 5.

5          Condition

                 If the person is granted the rating or endorsement (the authorisation) mentioned in paragraph 3 (a) and is not relying on the criterion for the exercise of the authorisation in paragraph 61.1130 (1) (a) of CASR, the person must ensure that at least 10 hours of the supervision mentioned in paragraph 61.1130 (2) (b) is direct supervision.

Note   The 10 hours of direct supervision required by the condition are in addition to the requirement for 10 hours direct supervision in paragraph 61.1130 (2) (a).
