Exemption — power-assisted glider at the Australian International Air Show, Avalon

1          Duration

            This instrument:

(a)   commences on 10 March 2009; and

(b)   stops having effect at the end of 15 March 2009.

2          Application

            This instrument applies to operations:

(a)   at The Australian International Air Show 2009, organised by AirShows DownUnder and held at Avalon, Victoria, from 10 March 2009 to 15 March 2009 inclusive; and

(b)   engaged in by the person mentioned in Schedule 1 (the pilot) while acting as pilot in command of the aircraft mentioned in Schedule 2 (the aircraft); and

(c)   that are approved by AirShows DownUnder.

3          Exemption

The aircraft and the pilot are exempt from compliance with the provisions of CAR 1988 mentioned in Schedule 3.

4          Conditions

            The exemption is subject to the conditions mentioned in Schedule 4.

Schedule 1          Pilot to whom the exemption applies

           Robert Jay Carlton, holder of FAA Commercial Pilot Licence Number 585026603.

Schedule 2          Aircraft to which the exemption applies

           H101 Salto jet-powered glider with United States Registration Number N‑101AZ.

Schedule 3Extent to which the exemption applies

      1     Parts 4, 4A, 4B, 4C, 4D, 5 and 7.

      2     Subregulations 83 (1), (2) and (3) in respect of VHF equipment.

      3     Part 11 (other than regulations 140, 143, 144, 149, 150, 151, 152 and 153).

      4     Paragraphs 166 (2) (c), (d), (f) and (g) (provided that an aircraft operating in the circuit area of a certificated or registered aerodrome must, as far as practicable, make all turns in the established circuit direction).

      5     Regulations 230 and 252.

Schedule 4          Conditions

      1     The pilot and the aircraft, to the extent applicable, must comply with Civil Aviation Order 95.4 other than paragraphs 4.1, 4.2, 4.3, 4.4 and 4.6.

      2     The pilot must comply with any limitations or conditions that are endorsed on his FAA Commercial Pilot Licence Number 585026603.
