Exemption — Asian Express operations at Auckland aerodrome

1          Duration

            This instrument:

(a)   commences on 25 March 2006; and

(b)   stops having effect at the end of 31 May 2006.

2          Definitions

            In this instrument:

aircraft means the Boeing 727-200 aircraft with nationality and registration marks VH-DHE operated by Asian Express Airlines Pty Ltd at Auckland aerodrome.

operator means Asian Express Airlines Pty Ltd.

3          Application

            This instrument applies to the operator, and the pilot in command, of the aircraft when it is landing or taking-off on runway 05L/23R while runway 05R/23L is under repair.

4          Exemptions

(1) The pilot in command of the aircraft is exempt from compliance with subregulations 92A (1), (3) and (4) of CAR 1988.

(2) The operator of the aircraft is exempt from compliance with subregulations 92A (3) and (4A) of CAR 1988.

5          Conditions

            The exemptions are subject to the conditions mentioned in Schedules 1 and 2.

Schedule 1          Conditions — take-off and landing on 05L/23R

      1     The aerodrome operator must have a reporting officer who:

(a)   meets the requirements of Part 139 of the Civil Aviation Rules of New Zealand(the NZ rules);and

(b)   performs the functions for reporting officers mentioned in that Part.

      2     Subject to clause 3, the aerodrome must have a movement area:

(a)   whose physical characteristics meet the standards in Part 139 of the NZ rules; and

(b)   whose markings meet the standards in that Part.

      3     For a take-off or landing on runway 05L/23R, the graded runway strip width reduction must be at least 122 metres for a distance of not more than 265 metres.

      4     The aerodrome must have an approved means of providing surface wind information for runway 05L/23R, and the pilot in command must have received that information before take-off or landing.

      5     The lighting system at the aerodrome must comply with Part 139 of the NZ rules.

      6     The operator and the pilot in command must comply with the Asian Express operations manual and any instructions or conditions issued under the Civil Aviation Act 1990 of New Zealand in relation to a take-off or landing on runway 05L/23R.

      7     The pilot in command of the aircraft engaged in a take-off or landing must have a copy of this exemption with him or her.

Schedule 2          Conditions — take-off on 23R only

      1     A take-off must be conducted by the pilot who has been designated by the operator as the pilot in command of the aircraft.

      2     The maximum crosswind must not exceed 60% of any limiting crosswind stated in the Asian Express operations manual in relation to take-off.

      3     A take-off must not be conducted in:

(a)    heavy rain; or

(b)    with standing water on the runway.

      4     The aircraft must not take-off if it has a permissible unserviceability, in the form of a minimum equipment list, for:

(a)   nose wheel steering; or

(b)   aeroplane braking; or

(c)   engine reverse thrust.
