Exemption — use of radiocommunication systems during parachute operations (Australian Parachute Federation)

1          Duration

                 This instrument:

(a)   commences on the day of registration; and

(b)   is repealed at the end of 30 June 2019.

2          Application

                 This instrument applies to a member of the Australian Parachute Federation Ltd (APF) who is acting as a ground control assistant during a parachute operation, or training for such operations.

3          Exemption

                 The member is exempt from compliance with regulation 83 of the Civil Aviation Regulations 1988 if the member is operating a radiocommunication system in the course of his or her duties.

4          Conditions

                 The exemption is subject to the following conditions:

(a)   the member must have completed a training course for the use of aviation radiocommunication systems which has been prescribed by the APF;

(b)   the person holding, or acting in, the position of the Manager of Safety and Training of the APF, or their delegate, must have:

             (i)  assessed the competency of the member to transmit ground-to-air communications to pilots in command of jump aircraft using aviation protocol; and

            (ii)  approved the competency of the member in writing;

(c)   the member must only use the aeronautical mobile radio frequency band allocated or licensed by the Australian Communications and Media Authority (ACMA) from time to time for parachute club operations;

Note   The ACMA has currently licensed the VHF 119.2 MHz frequency band for the purpose of parachute club operations under the Radiocommunications (Aircraft and Aeronautical Mobile Stations) Class Licence 2006.

(d)   the member must only use the radio frequency band mentioned in paragraph 4 (c) for ground-to-air communications with the pilot in command of the jump aircraft during parachute operations, or training for such operations;

(e)   the member must only operate a radiocommunication system with a transmitter output power which does not exceed 5 watts.
