Exemption — from having training and checking organisation

1          Duration

                 This instrument:

(a)   commences on 1 August 2016; and

(b)   is repealed at the end of 31 July 2019.

2          Definition

                 In this instrument:

aerial application operation has the meaning given by regulation 137.010 of CASR 1998.

3          Application

                 This instrument applies to an operator that operates only single engine aircraft (the aircraft):

(a)   with a maximum take-off weight of more than 5 700 kilograms; and

(b)   that are employed in aerial application operations.

4          Exemption

                 The operator is exempt from compliance with regulation 217 of the Civil Aviation Regulations 1988.

5          Conditions

                 The exemption is subject to the conditions mentioned in Schedule 1.

Schedule 1          Conditions

        1     The aircraft must:

(a)   be used exclusively for aerial application purposes; and

(b)   carry only crew members.

        2     The operations in which the aircraft is employed must be conducted in accordance with the operator’s operations manual.
