CASA EX114/18 — Flight Instructors (Training in Principles and Methods of Instruction) Exemption 2018

1          Name

                 This instrument is CASA EX114/18 — Flight Instructors (Training in Principles and Methods of Instruction) Exemption 2018.

2          Duration

                 This instrument:

(a)   commences on 1 September 2018; and

(b)   is repealed at the end of 31 August 2021.

3          Definitions

Note   In this instrument certain terms and expressions have the same meaning as they have in the CASR Dictionary, including: Part 141 operator and Part 142 operator. The terms flight instructor and simulator instructor are defined in regulation 61.010 of CASR. Part 141 flight training is defined in subregulation 141.015 (1) of CASR. Part 142 flight training is defined in subregulation 142.015 (2) of CASR.

                 In this instrument:

transitionedflight instructor means the holder of a flight instructor rating granted on the basis of regulation 202.272 or 202.274 of CASR.

transitionedsimulator instructor means the holder of a simulator instructor rating granted on the basis of regulation 202.272 or 202.274 of CASR.

4          Exemption — instructors

        (1)     A transitioned flight instructor is exempt from compliance with subregulation 61.065 (1) of CASR to the extent that the subregulation requires the instructor to comply with subregulation 61.1172 (2) of CASR to be authorised to exercise the privileges of the instructor’s flight instructor rating.

        (2)     A transitioned simulator instructor is exempt from compliance with subregulation 61.065 (1) of CASR to the extent that the subregulation requires the instructor to comply with subregulation 61.1197 (2) of CASR to be authorised to exercise the privileges of the instructor’s simulator instructor rating.

5          Exemption — Part 141 and 142 operators

        (1)     A Part 141 operator is exempt from compliance with subregulation 141.175 (1) of CASR to the extent that the subregulation requires the Part 141 operator to ensure that:

(a)   a transitioned flight instructor complies with regulation 61.1172 of CASR, in order for the flight instructor to be authorised under Part 61 of CASR to conduct Part 141 flight training for the operator.

(b)   a transitioned simulator instructor complies with regulation 61.1197 of CASR, in order for the simulator instructor to be authorised under Part 61 of CASR to conduct Part 141 flight training for the operator.

        (2)     A Part 142 operator is exempt from compliance with subregulation 142.230 (1) of CASR to the extent that the subregulation requires the Part 142 operator to ensure that:

(a)   a transitioned flight instructor complies with regulation 61.1172 of CASR, in order for the flight instructor to be authorised under Part 61 of CASR to conduct Part 142 flight training for the operator.

(b)   a transitioned simulator instructor complies with regulation 61.1197 of CASR, in order for the simulator instructor to be authorised under Part 61 of CASR to conduct Part 142 flight training for the operator.
