CIVIL AVIATION REGULATIONS

ILLUMINATION OF EMERGENCY EXITS ON CERTAIN AIRCRAFT

I, DARRYL KEITH GERLACH, a delegate of CASA, under subregulation 252 (1) of the Civil Aviation Regulations, having had regard to the type of operations in which the SAAB SF340 aircraft are used, direct that the aircraft’s emergency lighting switch may be turned off while there are passengers on board the aircraft during any period when:

(a)  the aircraft is on the ground; and

(b)  the aircraft’s engines are shut down;

subject to the operator complying with the conditions set out in Schedule 2.

Paragraph 9.1 of section 20.11 of the Civil Aviation Orders does not have effect in relation to the SAAB SF340 aircraft during the period the aircraft is on the ground and its engines are shut down.

In this instrument:

SAAB SF340 aircraft means the aircraft set out in Schedule 1.

SCHEDULE 1

AIRCRAFT

1.         SAAB SF340 aircraft operated by Kendell Airlines Pty Ltd (Aviation Reference Number 038444).

2.         SAAB SF340 aircraft operated by Hazelton Airlines Pty Limited (Aviation Reference Number 401866).


SCHEDULE 2

CONDITIONS

1.      The aircraft operator must ensure that at all times when the emergency lighting switch is turned off:

(a)     a pilot is in the aircraft’s cockpit; or

(b)     a flight attendant is at his or her station;

so that the emergency lighting system can be activated if and when required.

2.      The aircraft operator must ensure that the aircraft’s emergency lighting batteries are fully charged at all times and that the batteries are ready for immediate activation.
