Exemption — validation flight checks for AA

1          Duration

            This instrument:

(a)   commences on 25 February 2010; and

(b)   stops having effect at the end of 24 February 2012.

2          Application

            This instrument applies to Airservices Australia (AA) for the flight validation of terminal instrument flight procedures (TIFP) designed by AA under its procedure design certificate (AA TIFP).

3          Exemption

AA is exempt from compliance with regulation 173.095 of CASR 1998 to the extent mentioned in Schedule 1.

4          Conditions

            The exemption is subject to the conditions mentioned in Schedule 2.

Schedule 1          Extent of exemption

1The requirements in subregulation 173.095 (1) of CASR 1998, and in paragraph (a) of the definition of CASA pilot in subregulation 173.095 (2) of CASR 1998, that the validation pilot must be a CASA pilot who is an officer of CASA.

      2     The requirement in paragraph (b) of the definition of CASA pilot in subregulation 173.095 (2) of CASR 1998 to meet the standards in the following provisions of the Manual of Standards Part 173 — Standards Applicable to Instrument Flight Procedure Design (the MOS):

(a)   paragraph 6.1.2.4;

(b)   paragraph 6.1.2.5;

(c)   paragraph 7.1.5.3.

Schedule 2          Conditions

      1     Validation of an AA TIFP may only be conducted in accordance with the agreement between CASA and Radiola Aerospace Pty Ltd (Radiola), known as the Agreement Between Radiola Aerospace Pty Ltd and Civil Aviation Safety Authority (CASA) Flight Revalidation of Instrument Flight Procedures and Aerodrome Lighting Systems, Agreement No. 06/144-00.

      2     An AA TIFP may only be validated by 1 or more of the following pilots under engagement with Radiola (validation pilots):

(a)   William John McIntyre (Aviation Reference Number (ARN) 146239);

(b)   Albert Gregory Stewardson (ARN 545148);

(c)   Michael James Bird (ARN 508522).

Note 1   Each validation pilot must meet the standards for a pilot set out in paragraph 7.1.24 of the MOS.

Note 2   Under subregulation 173.095 (1) of CASR 1998, the validation must be in accordance with any applicable standards in the MOS.

      3     For validation of an AA TIFP, AA must provide an aircraft of a type approved by CASA.

      4     AA must give CASA at least 7 days’ written notice of any proposed validation activity, including of any proposed use of a flight simulator for purposes related to a validation.

      5     AA and each validation pilot must allow CASA officers to observe any validation activity on request.
