Exemption — emergency procedures proficiency tests for Qantas B737 aircraft

1          Duration

            This instrument:

(a)   commences on 29 February 2008; and

(b)   stops having effect at the end of 31 July 2011.

2          Application

            This instrument applies to the conduct of emergency procedures proficiency tests in B737 aircraft (the specified aircraft) operated by Qantas Airways Limited, Aviation Reference Number 216147 (Qantas).

3          Exemption — Qantas and crew members

(1) This instrument exempts Qantas and crew members of the specified aircraft from compliance with subregulations 252 (1A) and 253 (5) of CAR 1988.

   (2)     The exemption only applies to the extent mentioned in Schedule 1.

4          Conditions

            The exemption is subject to the conditions in Schedule 2.

Schedule 1          Extent of exemption

            The exemption extends only to the requirement to comply with:

(a)   paragraph 12.1 of Civil Aviation Order 20.11; and

(b)   paragraph 1.1 of Appendix 4 of that Order;

            in relation to the type of aircraft exit to be used in a proficiency test.

Schedule 2          Conditions

      1     The proficiency test for use of a B737 Type III exit must be the same as the proficiency test for use of a B767 Type III exit and include assessment of knowledge of differences.

      2     Before the proficiency test in the use of a B737 Type III exit, crew members must receive differences training, including the use of video, that:

(a)    shows the differences between B737 and B767 Type III exits; and

(b)    is consistent with any relevant guidance issued by the aircraft manufacturer.

      3     A B767 Type III exit used for the proficiency test in the use of a B737 Type III exit must be fully maintained and be representative of an actual exit.

      4     The proficiency test in the use of a B737 Type III exit must reflect the requirements of the actual emergency evacuation procedures that are to be followed on such aircraft.
