Exemption — materials flammability airworthiness standards for Medical Isolation Transportation Devices
1 Duration
This instrument:
(a) commences on the day of registration; and
(b) is repealed at the end of 30 June 2019.
2 Definition
In this instrument:
MITD means Medical Isolation Transportation Device.
3 Application
This instrument applies to:
(a) a person appointed under regulation 201.001 of CASR 1998 as an authorised person to grant a modification/repair design approval under regulation 21.437 of CASR 1998 (an authorised person); and
(b) a design organisation approved under regulation 21.243 of CASR 1998 to grant a modification/repair design approval under regulation 21.437 of CASR 1998 (an approved design organisation); and
(c) an applicant seeking a modification/repair design approval from an authorised person, or an approved design organisation, for the design of an MITD (an applicant).
4 Exemption
(1) An authorised person is exempt from compliance with regulation 21.437 of CASR 1998, but only to the extent that the authorised person must be satisfied that an applicant’s design for an MITD complies with the applicable airworthiness standards for materials flammability before granting a modification/repair design approval.
(2) An approved design organisation is exempt from compliance with regulation 21.437 of CASR 1998, but only to the extent that the approved design organisation must be satisfied that an applicant’s design for an MITD complies with the applicable airworthiness standards for materials flammability before granting a modification/repair design approval.
Note Materials flammability standards are contained in a wide range of publications, such as FAR/JAR/CS §2#.853.
5 Savings
A modification/repair design approval issued by an authorised person, or an approved design organisation, in accordance with this exemption will continue to have effect after the expiry of this exemption.
6 Conditions
The exemption is subject to the conditions mentioned in Schedule 1.
Schedule 1 Conditions
1 The approved flight manual supplement for an aircraft installed with an MITD must include:
(a) a notice to crew that the MITD does not meet cabin interior materials flammability requirements; and
(b) an additional briefing to occupants on board the aircraft which instructs them on the fire containment procedures associated with the MITD.
2 The MITD must be placarded with a statement visible to the aircraft occupants that the MITD does not meet the cabin interior materials flammability requirements.
3 An aircraft installed with an MITD must contain at least 1 fire extinguisher that is easily accessible to occupants of the cabin.
