Exemption — attendance of all operational ARFFS staff at CASA accredited training

1              Duration

                This instrument:

(a)     commences on theday after it is registered; and

(b)     stops having effect at the end of 31 January 2011.

2              Application

                This instrument applies to attendance of Aerodrome Rescue and Fire Fighting Services (ARFFS) staff at a CASA accredited ARFFS training course on:

(a)     instructions on technological change; and

(b)     revised firefighting procedures.

3              Exemption

                Each ARFFS operational staff member is exempt from compliance with the provisions of CASR 1998 mentioned in Schedule 1 in respect of the provisions of the Manual of Standards Part 139H (the MOS) mentioned in that Schedule.

4              Conditions

                The exemption is subject to the conditions mentioned in Schedule 2.

Schedule 1             Provisions

        1      Subregulation 139.845 (4) of CASR 1998 in respect of paragraph 18.1.1.4 of the MOS.

Note   Paragraph 18.1.1.4 requires all staff to attend a CASA accredited ARFFS training course at intervals not exceeding four years for instruction on technological changes and to practice revised firefighting procedures.

Schedule 2             Conditions

        1         Airservices Australia (AA) as the approved ARFFS provider must make every effort to develop a program that provides instructions on technological changes in firefighting procedures that may provide the appropriate levels of competency for ARFFS staff.

        2      Every 6 months from the date of the coming into effect of this instrument AA must provide CASA with a progress report on the development of the program.

        3      If AA develops a program, AA must apply to CASA for accreditation of the program.

        4      CASA must accredit a program if CASA is satisfied that the program meets the required competencies for operational staff.

        5      If CASA accredits a program AA must ensure that arrangements are in place for delivery of program to all ARFFS staff in a timely manner.
