Exemption — GNSS requirements (Express Freighters Australia)

1          Duration

                 This instrument:

(a)   commences on 4 February 2016; and

(b)   expires at the end of 25 May 2016, as if it had been repealed by another instrument.

2          Definitions

                 In this instrument:

DME means distance measuring equipment.

DME/DME updating means the simultaneous use of 2 DME stations for aircraft position estimation.

GNSS means global navigation satellite system.

3          Application

                 This instrument applies to a B737-300 aircraft (the aircraft) operated by Express Freighters Australia Pty Limited, Aviation Reference Number 503021 (the operator), that:

(a)   was first registered in Australia before 6 February 2014; and

(b)   is engaged in regular public transport operations or charter operations under the I.F.R.

4          Exemption

                 The aircraft is exempt from complying with the requirements of paragraph 9D.5 of Civil Aviation Order 20.18.

5          Conditions

                 The exemption is subject to the conditions mentioned in Schedule1.

Schedule 1          Conditions

        1     The operator must ensure that the aircraft is equipped with the following:

(a)   2 serviceable inertial reference systems;

(b)   a serviceable flight management computer.

        2     The operator must ensure that DME/DME updating is available for the aircraft.

Note   The level of operability does not require DME/DME updating to be continuously achieved.

        3     The operator must identify any navigation aids necessary to achieve the accuracy required for the intended route or procedure (a critical navigation aid). If a critical navigation aid is not available, but is required for the intended route or procedure, the operator must ensure that the flight:

(a)   is rescheduled until the critical navigation aid is available; or

(b)   uses an alternative route or procedure that does not require the use of the unavailable critical navigation aid.

        4     The operator must include a copy of this instrument in the operator’s operations manual.
