Exemption — recognition of EASA type certification

1          Duration

                 This exemption commences on the day after registration and expires, as if it had been repealed by another instrument, on whichever of the following happens first:

(a)the end of 31 January 2015; or

(b)the commencement of regulation 21.010A of CASR 1998.

2          Application

This exemption applies to an applicant for a type acceptance certificate for an aircraft manufactured in a non-recognised country, in respect of which a type certificate has been issued by the European Aviation Safety Agency (EASA).

3          Definition

                 In this instrument:

non-recognised country means a foreign country that is not a recognised country referred to in regulation 21.012 of CASR 1998.

4          Exemption

A person to whom section 2 applies is exempt from compliance with paragraph 21.029A (a), and subregulation 21.029B (1), of CASR 1998.

5          Conditions on type acceptance certificate

CASA may issue a type acceptance certificate subject to whatever conditions it considers necessary in the interests of aviation safety, following consultation with the applicant, the manufacturer of the aircraft and EASA.

6          Conditions of exemption

                 This exemption is subject to the conditions mentioned in Schedule 1.

Schedule 1          Conditions

1 An applicant must provide CASA with all the details referred to in paragraph 21.029A (b) of CASR 1998, as if a reference in paragraph 21.029A (b) to a recognised country were a reference to EASA.

2 A type acceptance certificate issued to an applicant under this exemption is subject to suspension or cancellation under regulation 21.051 of CASR 1998, as if it were a type acceptance certificate issued to the holder of a type certificate issued by the national aviation authority of a recognised country.
