EXEMPTION UNDER REGULATION 308

I, WILLIAM BRUCE BYRON, Director of Aviation Safety, on behalf of CASA, under regulation 308 of the Civil Aviation Regulations 1988, having taken into account all relevant considerations relating to the interests of safety, exempt the Boeing Stearman bi-plane bearing the nationality and registration marks VH‑ZYZ from compliance with subparagraph 45.065 (3) b) (ii) of the Civil Aviation Safety Regulations 1998, subject to compliance with the condition set out in Schedule 1.

SCHEDULE 1

CONDITION

  1. The aircraft’s nationality and registration marks must be painted:

(a)on both sides of the aircraft’s rear fuselage;  and

(b)in characters that are not less than 50 mm high.

This exemption takes effect on gazettal and stops having effect:

(a)if the aircraft’s colour scheme is changed;  or

(b)at the end of February 2007;

whichever happens first.
