EXEMPTION UNDER SUBREGULATION 308 (1) RELATING TO

EMERGENCY PROCEDURES PROFICIENCY TEST FOR QANTAS

B737 AIRCRAFT

I, BRUCE ROBERT GEMMELL, Deputy Chief Executive and Chief Operating Officer, a delegate of CASA, having taken into account all relevant considerations relating to the interests of safety:

(a)under subregulation 308 (1) of the Civil Aviation Regulations 1988 (CAR 1988), in relation to specified aircraft, exempt Qantas and crew members from compliance with subregulations 252 (1A) and 253 (5) to the extent mentioned in Schedule 1;  and

(b)issue the exemption subject to the conditions mentioned in Schedule 2.

In this exemption:

crew members means crew members on specified aircraft.

Qantas means Qantas Airways Limited operating under Air Operator’s Certificate number 216147.

specified aircraft means B737 aircraft operated by Qantas.

SCHEDULE 1

Extent of exemption

The exemption extends only to the requirement to comply with:

(a)paragraph 12.1 of section 20.11 of the Civil Aviation Orders;  and

(b)paragraph 1.1 of Appendix 4 of that section;

in relation to the type of aircraft exit to be used in a proficiency test.

SCHEDULE 2

Conditions

  1. The proficiency test for use of a B737 Type III exit must be the same as the proficiency test for use of a B767 Type III exit and include assessment of knowledge of differences.

  1. Before the proficiency test in the use of a B737 Type III exit, crew members must receive differences training, including the use of video, that:

(a)   shows the differences between B737 and B767 Type III exits;  and

(b)is consistent with any relevant guidance issued by the aircraft manufacturer.

  1. A B767 Type III exit used for the proficiency test in the use of a B737 Type III exit must be fully maintained and be representative of an actual exit.

  1. The proficiency test in the use of a B737 Type III exit must reflect the requirements of the actual emergency evacuation procedures that are to be followed on such aircraft.

This exemption takes effect at the start of the day after it is registered on the Federal Register of Legislative Instruments.

This exemption stops having effect at the end of 28 February 2008.
