Exemption — use of ADS-B in aircraft operated by Hi Fly, Lisbon, Portugal

1          Duration

This instrument:

(a)   commences on the day after registration; and

(b)   stops having effect at the end of 11 December 2013.

2          Application

This instrument applies to the carriage of compliant Automatic Dependent Surveillance – Broadcast (ADS-B) equipment by aircraft operated by Hi Fly, of Lisbon, Portugal, (the operator).

3          Exemption

The operator, and the pilot in command, are exempt from compliance with the technical standards in Appendixes 4 and 5 to Civil Aviation Order 82.5, as they relate to the carriage of compliant ADS-B equipment in an aircraft mentioned in Schedule 1.

4          Conditions

The exemption is subject to the conditions mentioned in Schedule 2.

Schedule 2          Conditions

1     The pilot in command must not indicate ADS-B equipage on the flight plans for any of the aircraft.

2     The operator must provide CASA with a progress report as each aircraft is replaced with an aircraft that is compliant with current ADS-B requirements.
