Exemption — operations by RAA aircraft in Avalon aerodrome temporary restricted area

1          Duration

This instrument:

(a)   commences on the day after it is registered; and

(b)   stops having effect at the end of 30 April 2009.

2          Application

(1)            This instrument applies to an aeroplane to which Civil Aviation Order (CAO) 95.32 (CAO 95.32 aeroplane) or 95.55 (CAO 95.55 aeroplane) applies and which is registered with Recreational Aviation Australia (RAA), Aviation Reference Number 224806.

(2)            This instrument only applies to operations in a temporary restricted area in the vicinity of Avalon aerodrome, Victoria.

3          Exemption

For this exemption, the operator of such an aeroplane is exempt from complying with the following provisions of CAR 1988:

(a)   Part 4 in the case of a CAO 95.32 aeroplane only;

(b)   regulations 36A and 37 in the case of a CAO 95.55 aeroplane;

(c)   Parts  4A, 4B, 4C, 4D and 5;

(d)   Part 7 in the case of a CAO 95.32 aeroplane only;

(e)   subregulations 83 (1), (2) and (3) in respect of VHF equipment;

(f)    regulations 133, 139, 155,  and 157;

(g)   regulation 210 insofar as advertising of flying operations to qualify for a standard specified in the RAA Operations Manual is concerned;

(h)   regulation 230;

(i)    subregulation 242 (2);

(j)    regulations 252 and 252A.

4          Conditions

The exemption is subject to the conditions mentioned in Schedule 1.

Schedule 1          Conditions

1The conditions in this Schedule only apply to aeroplanes flying in a temporary restricted area declared around Avalon aerodrome under regulation 6 of the Airspace Regulations 2007.

2The aeroplane must comply with the conditions, other than subparagraph 5.1(e) in either CAO, to which the aircraft is subject under CAO 95.32 or CAO 95.55.

Note:  Subparagraph 5.1(e) prohibits flying inside an active prohibited or restricted area.

3     In order to operate in the temporary restricted area, the aeroplane must be fitted with:

(a)a radio capable of two-way communication with Air Traffic Control (ATC) and Certified Air/Ground Radio Service (CA/GRS); and

(b)          a transponder capable of mode A and C operation maintained by an approved aircraft maintenance organisation in accordance with CASA AD/RAD/47 current at the time of this instrument.

4     The pilot in command must hold at least a valid RAA pilot certificate.

5     As soon as possible after any incident or accident in the temporary restricted area, the pilot in command must report it to the Australian Transport Safety Bureau.
