CASA EX01/22 – ATC Licence (RMON Endorsement) – Exemptions from Recency and Currency Requirements Instrument 2022
1 Name
This instrument is CASA EX01/22 – ATC Licence (RMON Endorsement) – Exemptions from Recency and Currency Requirements Instrument 2022.
2 Duration
This instrument:
(a) commences on the day after it is registered; and
(b) is repealed at the end of 31 July 2023.
Note For regulation 11.250 of CASR, the directions in section 6 cease to be in force at the end of 31 July 2023.
3 Interpretation
Note In this instrument, certain terms and expressions have the same meaning as they have in the Civil Aviation Act 1988 and the regulations. These include: ATC licence.
(1) In this instrument:
AA Licensing and Certificates Manual means ATS Licensing and Certificates Manual, prepared by Airservices Australia, ARN 202210, as existing from time to time.
Alpine Local Instructions means the document entitled Alpine Local Instructions – Procedure, prepared by Airservices Australia as existing from time to time.
ML simulator means the Eurocat simulator that is:
(a) operated by Airservices Australia;
(b) located in the Melbourne Air Traffic Services Centre; and
(c) designed, amongst other things, to simulate a live operational environment for RMON endorsement functions.
OVN endorsement means the endorsement referred to in the Alpine Local Instructions as “RS SE AREA (P&R) SECTOR OVN”.
RMON endorsement means the endorsement referred to in the Alpine Local Instructions as “RESTRICTED MONARO ENDORSEMENT”.
SNOW endorsement means the endorsement referred to in the Alpine Local Instructions as “RS SE AREA (P&R) SECTOR SNOW”.
(2) For the avoidance of doubt, a reference in this instrument to holding an endorsement includes a reference to having satisfied the recency and currency requirements under regulations 65.025 and 65.030 of CASR respectively in relation to the endorsement.
4 Application
This instrument applies in relation to an ATC licence holder who:
(a) performs air traffic control functions under an RMON endorsement; and
(b) holds the OVN and SNOW endorsements, gained by actual performance of functions in the live operational environment (and not on a simulator).
5 Exemptions
(1) An ATC licence holder to whom this instrument applies is exempt from subregulation 65.045 (1) of CASR to the extent that the provision requires the licence holder to comply with the recency requirement mentioned in subparagraph 65.035 (1) (c) (i) in the manner specified in subparagraph 65.025 (3) (a) (i) in relation to the RMON endorsement, if the licence holder has carried out the RMON endorsement functions under supervision on the ML simulator for at least 1 hour (or such longer time as may be required for the completion of at least 1 simulator exercise) for each month or part of a month that has passed since the licence holder last performed those functions.
(2) An ATC licence holder to whom this instrument applies is exempt from subregulation 65.045 (1) of CASR to the extent that the provision requires the licence holder to comply with the currency requirement mentioned in subparagraph 65.035 (1) (c) (i) in the manner specified in paragraph 65.030 (1) (b) in relation to the RMON endorsement, if, within the previous 6 months, the licence holder’s performance of the RMON endorsement functions, as carried out on the ML simulator for at least 2 hours (or such longer time as may be required for the completion of at least 2 simulator exercises), has been assessed as satisfactory.
6 Directions
(1) Airservices Australia must ensure that the person supervising the functions mentioned in subsection 5 (1) in relation to an ATC licence holder holds an RMON endorsement.
(2) Airservices Australia must ensure that:
(a) an assessment mentioned in subsection 5 (2) is carried out by a person who:
(i) has demonstrated competence as a workplace assessor under section 3.1.14 of the Manual of Standards (MOS) – Part 65; and
(ii) holds an RMON endorsement; and
(b) the currency requirements for the RMON, OVN and SNOW endorsements are assessed collectively, with the currency requirement for the RMON endorsement assessed last.
(3) Airservices Australia must ensure that:
(a) the ML simulator, software and data set are, at all times that the simulator is used for the purposes of this instrument, aligned with the live operational environment for the RMON endorsement; and
(b) the simulator exercises for the RMON endorsement (the RMON exercises) are regularly monitored to ensure that the content remains aligned with the live operational environment for the endorsement; and
(c) a suitably qualified person has been assigned the task of confirming that each new RMON exercise, or variation of an RMON exercise, is fit‑for‑purpose and aligned with the live operational environment before its use; and
(d) a sufficient number and variety of RMON exercises are available so that an ATC licence holder does not repeat an RMON exercise within a 12-month period; and
(e) the RMON exercises completed by the licence holder are recorded and monitored to ensure the licence holder does not repeat an exercise within a 12-month period; and
(f) air safety and efficiency of ATC operations are not compromised under the exemptions in this instrument; and
(g) no change is made to the AA Licensing and Certificates Manual or the Alpine Local Instructions that affects the ambit of the exemptions under this instrument (including provisions relating to the recency or currency requirements or the scope, description or sectors of any of the endorsements) without CASA’s prior written approval.
(4) Airservices Australia must, no later than 3 months before the repeal of this instrument, provide CASA with a report detailing the manner in which the requirements under subsection (3) have been satisfied.
