EXEMPTION UNDER SUBREGULATION 308 (1) RELATING TO FUEL DISCREPANCY ALLOWANCE FOR QANTAS B747-300 AIRCRAFT

I, WILLIAM BRUCE BYRON, Director of Aviation Safety, having taken into account all relevant considerations relating to the interests of safety:

(a)in respect of all Boeing aircraft operated by Qantas, revoke all previous exemptions that exempted Qantas from compliance with subregulation 244 (2) of the Civil Aviation Regulations 1988 (CAR 1988) to the extent mentioned in Schedule 1;  and

(b)under subregulation 308 (1) of CAR 1988 exempt B747-300 aircraft operated by Qantas (the aircraft) from compliance with subregulation 244 (2) of CAR 1988 to the extent mentioned in Schedule 1.

This exemption is subject to compliance with the conditions mentioned in Schedule 2.

In this exemption:

higher fuel quantity means the higher amount of fuel quantity on board the aircraft determined in accordance with paragraph 6.1 of section 20.2 of the Civil Aviation Orders (CAOs).

lower fuel quantity means the lower amount of fuel quantity on board the aircraft determined in accordance with paragraph 6.1 of section 20.2 of the CAOs.

minimum fuel required  means the minimum fuel quantity required for the flight including reserves.

Qantas means Qantas Airways Limited operating under Air Operator’s Certificate number 216147.

SCHEDULE 1

Extent of exemption

The exemption extends only to the requirement to comply with paragraph 6.2 of section 20.2 of the CAOs providing for a maximum allowable discrepancy of 3% in fuel quantity measurements.

SCHEDULE 2

Conditions

  1. If the minimum fuel required is 25 000 kg or less, the allowable discrepancy is not more than 6% of the higher fuel quantity.

  2. If the minimum fuel required is 25 000 kg or more, the allowable discrepancy is not more than 6% of the higher fuel quantity, reducing on a pro rata basis to 3% if the minimum fuel required is 50 000 kg.

  3. If the minimum fuel required is more than 50 000 kg, the allowable discrepancy is not more than 3% of the higher fuel quantity.

  4. If the allowable discrepancy exceeds 3%, the lower fuel quantity must be not less than the minimum fuel required.

    This exemption takes effect at the start of the day after it is registered on the Federal Register of Legislative Instruments.

    This exemption stops having effect at the end of 31 July 2008.
