Direction — number of cabin attendants (JetGo Australia Holdings)
1 Duration
This instrument:
(a) commences on the day of registration; and
(b) is repealed at the end of 31 July 2018.
2 Application
This instrument applies to the aircraft mentioned in section 3 that are:
(a) operated by JetGo Australia Holdings Pty Ltd, Aviation Reference Number 805527 (the operator); and
(b) engaged in regular public transport, or charter, operations.
3 Direction
In spite of subparagraph 6.1 (b) of Civil Aviation Order (CAO) 20.16.3, the operator may operate any of the following Australian registered aircraft:
(a) Embraer EMB 135 series aircraft, excluding EMB-135KE and EMB‑135KL series aircraft, with a type certificate data sheet that provides for a maximum seating capacity of 37 passengers;
(b) Embraer EMB-135KL series aircraft with a type certificate data sheet that provides for a maximum seating capacity of 44 passengers;
(c) Embraer EMB 145 series aircraft with a type certificate data sheet that provides for a maximum seating capacity of 50 passengers;
if there is 1 cabin attendant for every 50 passenger seats or part of that number.
Note CAO 20.16.3 applies in all other respects to an aircraft referred to in this section.
4 Conditions
The direction is subject to the conditions mentioned in Schedule 1.
Schedule 1 Conditions
1 This direction only applies to the Embraer EMB-135KL series aircraft and EMB 145 series aircraft if not more than the following number of passengers are seated on board the aircraft:
(a) 37 passengers; or
(b) for EMB-135KL series aircraft — a number of passengers approved in writing by CASA not exceeding 44 passengers;
(c) for EMB 145 series aircraft — a number of passengers approved in writing by CASA not exceeding 50 passengers.
2 Only physically competent (able-bodied) persons may occupy seats in the emergency exit rows of the aircraft.
3 During the aircraft take-off or landing and in prepared emergencies, the emergency exit row seats must be occupied by able-bodied persons.
4 The number of able-bodied persons available to occupy the seats in the emergency exit rows must be determined only after the weight and balance requirements applicable to the loading of the aircraft have been complied with.
5 If less than 4 able-bodied persons are available to occupy the seats in the emergency exit rows, the operator must ensure that after compliance with the weight and balance loading requirements, the emergency exit rows are occupied in the following sequence:
(a) for Embraer EMB 135 series aircraft, except EMB‑135KL series aircraft:
(i) row 9, seat A; and
(ii) row 9, seat C; and
(iii) row 9, seat B; and
(iv) row 1, seat A;
(b) for Embraer EMB-135KL series aircraft:
(i) row 11, seat A; and
(ii) row 11, seat C; and
(iii) row 11, seat B; and
(iv) row 1, seat A;
(c) for Embraer EMB 145 series aircraft:
(i) row 12, seat A; and
(ii) row 12, seat C; and
(iii) row 12, seat B; and
(iv) row 1, seat A.
6 All passengers seated in the emergency exit rows must receive and respond to a briefing acceptable to CASA which instructs them in the operation of the emergency exits and subsequent actions required in the event of an emergency.
7 Arrangements for the seating and briefing of passengers must be in accordance with procedures set out in the operator’s operations manual and acceptable to CASA.
8 The operator must ensure that the aircraft can be evacuated in 90 seconds.
9 A copy of this direction must be included in the operator’s operations manual.
