CASA 67/19 — Number of Cabin Attendants (National Jet Express) Direction 2019

1          Name

                 This instrument is CASA 67/19 — Number of Cabin Attendants (National Jet Express) Direction 2019.

2          Duration

                 This instrument:

(a)   commences on the day after it is registered; and

(b)   is repealed at the earlier of:

             (i)  the commencement of the Civil Aviation Safety Amendment (Part 121) Regulations 2018; and

            (ii)  the end of 30 September 2021.

3          Repeal of CASA 06/18

Instrument CASA 06/18 — Number of Cabin Attendants (National Jet Express) Direction 2018 is repealed.

4          Application

                 This instrument applies to National Jet Express Pty Ltd (National Jet Express), ARN 580965, if National Jet Express operates any of the following aircraft (the relevant aircraft)in charter, or regular public transport, operations:

(a)   AVRO 146-RJ85 series aircraft that have the maximum seating capacity (including crew) of 118 individuals, mentioned in a type certificate data sheet for that series of aircraft;

(b)   AVRO 146-RJ100 series aircraft that have the maximum seating capacity (including crew) of 118 individuals, mentioned in a type certificate data sheet for that series of aircraft;

(c)   BAe 146‑100 series aircraft that have the maximum seating capacity (including crew) of 100 individuals, mentioned in a type certificate data sheet for that series of aircraft;

(d)   BAe 146-100A series aircraft that have the maximum passenger seating for 94 passengers, in accordance with the approved only setting configuration, mentioned in a type certificate data sheet for that series of aircraft;

(e)   BAe 146‑200 series aircraft that have the maximum seating capacity (including crew) of 118 individuals, mentioned in a type certificate data sheet for that series of aircraft;

(f)    BAe 146-200A series aircraft that have the maximum passenger seating for 108 passengers, with an approved interior configuration or an approved seating configuration, mentioned in a type certificate data sheet for that series of aircraft;

(g)   BAe 146‑300 series aircraft that have the maximum seating capacity (including crew) of 118 individuals, mentioned in a type certificate data sheet for that series of aircraft;

(h)   DHC‑8‑402 series aircraft that have the maximum passenger seating capacity of 80 passengers, with an approved cabin interior configuration and an approved seating configuration, mentioned in a type certificate data sheet for that series of aircraft;

(i)    ERJ 190‑100 IGW series aircraft that have the maximum passenger capacity of 114 passengers mentioned in a type certificate data sheet for that series of aircraft;

(j)    ERJ 190‑100 LR series aircraft that have the maximum passenger capacity of 114 passengers mentioned in a type certificate data sheet for that series of aircraft.

Note   In this instrument, certain terms and expressionshave the same meaning as they have in the Civil Aviation Act 1988 and the regulations. These include: maximum passenger seating capacity, passenger, regular public transport operations and type certificate data sheet.

5          Directions

        (1)     Subparagraph 6.1 (b) of Civil Aviation Order 20.16.3, as in force from time to time, does not apply to National Jet Express in respect of its operation of the relevant aircraft.

        (2)     National Jet Express must assign for duty at least 1 cabin attendant for every 50 passenger seats or part of that number fitted to the relevant aircraft.

        (3)     National Jet Express must give written notice to CASA at least 14 days before making any revision to any part of its operations manual that affects emergency procedures for the relevant aircraft, including in relation to exits or procedures relating to able-bodied passengers.
