Directions — for determining maximum weight
1 Duration
This instrument:
(a) commences on the day after it is registered; and
(b) stops having effect at the end of 31 December 2006.
2 Revocation
CASA instrument EX42/2004 is revoked.
3 Application
This instrument applies to each aircraft mentioned in Schedule 1 (the aircraft) when it is:
(a) equipped with an external loop antenna; and
(b) operated by Fugro Airborne Surveys Pty Ltd (Aviation Reference Number 401318) (the operator).

I give the directions in Schedule 2.

Schedule 2 Directions
1 If a flight, take-off or landing (an operation) includes, or is likely to include, any of the circumstances mentioned in clause 3, the maximum weight that the gross weight of the aircraft is not to exceed at take-off or landing (MTOW), is to be determined through compliance with Civil Aviation Order 20.7.1B as if that Order applied to the aircraft in the circumstance.
2 If an operation does not include, or is not likely to include, any of the circumstances mentioned in clause 3, the MTOW is to be determined through compliance with Civil Aviation Order 20.7.4 as if that Order applied to the aircraft.
3 The circumstances are:
(a) flight outside daylight;
(b) except with the written approval of CASA — a take-off whose flight path involves flight below 1 000 feet AGL for more than 3 km over a city, town, populous or industrial area, or industrial plant (a restricted area);
(c) except in an emergency, or with the written approval of CASA — a landing whose flight path involves flight below 1 000 feet AGL for more than 3 km over a restricted area.
