FOR SUBREGULATION 251 (9)

LEAVING AND BOARDING HELICOPTERS DURING SPECIAL OPERATIONS

I, JOHN FLANNERY, Acting General Manager, General Aviation Operations, Aviation Safety Compliance, a delegate of CASA:

(a)revoke instrument CASA 561/04;  and

(b)under subregulation 250 (2) of the Civil Aviation Regulations 1988 (CAR 1988), permit a passenger to be carried on the undercarriage of a helicopter engaged in a special operation conducted by an operator specified in Schedule 1 in accordance with the condition set out in Schedule 2:

(i)while the helicopter is in the hover;  and

(ii)if the passenger is in the course of leaving or boarding the helicopter for the purpose of the operation;  and

(c)under subregulation 207 (3) of CAR 1988, direct that a passenger in a helicopter engaged in a special operation in accordance with the condition set out in Schedule 2 is not required to occupy a seat when the helicopter is in a hover for the purpose of permitting the passenger to leave or board the helicopter;  and

(d)for the purposes of subregulation 251 (9) of CAR 1988, direct that a passenger in a helicopter engaged in a special operation in accordance with the condition set out in Schedule 2 is not required to wear a seat belt when the helicopter is in a hover for the purpose of permitting the passenger to leave or board the helicopter.

In this instrument, special operation means a search and rescue operation, law enforcement operation, fire fighting operation, or training for such an operation, in which, for the purpose of the operation, it is necessary to leave or board the helicopter when a landing is not possible or safe.

CONDITION
