Authorisation — to carry out maintenance on class A or class B aircraft
Exemption — to certify maintenance on class A or class B aircraft

1          Duration

            This instrument:

(a)   commences on the day after it is registered; and

(b)   stops having effect at the end of January 2012.

2          Application

            This instrument applies to maintenance in the form of aircraft polishing carried out by Damlan Pty Limited, trading as Manta Aviation, Aviation Reference Number 601671 (the operator).

3          Authorisation — to carry out aircraft polishing maintenance

For paragraphs 42ZC (3) (d) and (4) (e) of CAR 1988, a person employed by the operator and carrying out aircraft polishing to which this instrument applies (an aircraft polisher) is authorised to do so subject to Schedules 1 and 2.

4          Exemption — to certify aircraft polishing maintenance

An aircraft polisher who carries out aircraft polishing in accordance with the authorisation is exempt from compliance with paragraph 42ZE (1) (b) of CAR 1988 subject to the condition mentioned in Schedule 3.

5          Conditions on authorisation

   (1)     For class A aircraft, the authorisation is subject to the conditions mentioned in Schedule 1.

   (2)     For class B aircraft, the authorisation is subject to the conditions mentioned in Schedule 2.

6          Definition

            In this instrument:

qualified supervisor means a person who holds an aircraft maintenance engineer licence, or a maintenance authority covering maintenance on the class of aircraft, and who is:

(a)   present in person to observe a person performing polishing operations on an aircraft, to the extent necessary to ensure that it is being performed properly; and

(b)   immediately available in person to give advice to, or answer questions from, the person performing the aircraft polishing.

Schedule 1          Conditions for authorisation — class A aircraft

            The aircraft polisher must:

(a)   be employed by, or work under an arrangement with, a person who holds a certificate of approval covering aircraft polishing; and

(b)   be supervised by a qualified supervisor who is also employed by, or works under an arrangement with, a person referred to in paragraph (a).

Schedule 2          Conditions for authorisation — class B aircraft

            The aircraft polisher must be supervised by a qualified supervisor who may be:

(a)   an independent contractor; or

(b)   employed by a person who holds an aircraft maintenance engineer licence or an airworthiness authority.

Schedule 3          Condition of exemption

            Only a qualified supervisor may certify for completion of the aircraft polishing by the aircraft polisher.
