Authorisation, permission and direction — helicopter special operations
1 Duration
This instrument:
(a) commences on the day after it is registered; and
(b) stops having effect at the end of 31 October 2009.
2 Application
(1) Subject to subsection (2), this instrument applies to a helicopter flight mentioned in Schedule 1 (a special operation) by each operator mentioned in Schedule 2.
(2) The reference in Schedule 1 to a helicopter law enforcement, or related training, operation applies only to Skyplan Australia Pty Ltd, State of Queensland acting through the Department of Emergency Services known as Emergency Management Queensland Helicopter Rescue and the State of Victoria in relation to Victoria Police Air Wing.
3 Authorisation
The pilot in command of a helicopter operated by an operator mentioned in Schedule 2 may pick up a person when the helicopter is in flight.
4 Permission
When a helicopter is in the hover to enable a passenger to leave or board, the passenger may be carried on the undercarriage for the purpose of leaving or boarding.
5 Direction
When a helicopter is in the hover to enable a passenger to leave or board, the passenger is not required to occupy a seat or wear a seat belt.
6 Condition
Each permission in section 4 is subject to the condition mentioned in Schedule 3.
Schedule 1 Special operation
A helicopter search and rescue, law enforcement, firefighting or related training operation, in which, for the purpose of the operation or training, it is necessary for a person to leave or board the helicopter when a landing is not possible or safe.
Note The reference to a helicopter law enforcement, or related training, operation applies only to Skyplan Australia Pty Ltd, State of Queensland acting through the Department of Emergency Services known as Emergency Management Queensland Helicopter Rescue and the State of Victoria in relation to Victoria Police Air Wing: see subsection 2 (2).
