1 Name
This instrument is CASA 40/20 — Number of Cabin Attendants (National Jet Systems) Direction 2020.
2 Duration
This instrument:
(a) commences on 1 August 2020; and
(b) is repealed at the earlier of the following:
(i) the commencement of the Civil Aviation Safety Amendment (Part 121) Regulations 2018;
(ii) the end of 31 July 2022.
Note For regulation 11.250 of CASR, the directions in section 5 cease to be in force at the earlier of the times mentioned in paragraph (b).
3 Definitions
Note In this instrument, certain terms and expressions have the same meaning as they have in the Civil Aviation Act 1988 and the regulations. These include: operations manual, passenger, regular public transport operationsand type certificate data sheet.
In this instrument:
cabin attendanthas the meaning given by subsection 2 of Civil Aviation Order 20.16.3.
relevant aircraft means a Boeing B717-200 series aircraft with a type certificate data sheet that, at the time this instrument commences, mentions a maximum seating capacity of 134 passengers.
National Jet Systems means National Jet Systems Pty Ltd, ARN 436109.
4 Application
This instrument applies to National Jet Systems in relation to its operation of a relevant aircraft in charter, or regular public transport, operations.
5 Directions
(1) Subparagraph 6.1 (b) of Civil Aviation Order 20.16.3, as in force from time to time, does not apply to National Jet Systems in relation to its operation of a relevant aircraft.
(2) National Jet Systems must assign for duty at least 1 cabin attendant for each 50, or part of 50, passenger seats fitted for each flight of a relevant aircraft.
(3) National Jet Systems must give CASA:
(a) written notice of any proposed revision of any part of National Jet Systems’ operations manual that relates to emergency procedures for a relevant aircraft, including in relation to exits; and
(b) the written notice mentioned in paragraph (a) at least 14 days before making any proposed revision.
