I, matthew john Anderson, Team Leader Flying Operations, General Aviation Field Office, Moorabin, a delegate of CASA, make this instrument under:

(a)   subregulations 155 (6) and (7) of the Civil Aviation Regulations 1988 (CAR 1988); and

(b) paragraphs 156 (1) (a) and 157 (4) (b) of CAR 1988; and

(b)   subsection 2 of Civil Aviation Order 29.4 (CAO 29.4).

Permission — for acrobatic flight over a place, flight over a public gathering and low flight

Approval — for an air display

1          Duration

            This instrument:

(a)   commences on 1 July 2006; and

(b)   stops having effect at the end of 30 June 2009.

2          Application

This instrument applies to:

(a)   an air display at Point Cook Airfield, Victoria (the airfield) conducted by the RAAF Museum in accordance with the application submitted to CASA on 20 May 2003; and

(b)   each operator and pilot in command of an aircraft officially engaged in operations or flight in the air display.

3          Approval — to conduct an air display

   (1)     The RAAF Museum may conduct an air display at Point Cook Airfield, Victoria.

   (2)     The approval is subject to the conditions mentioned in Schedule 1.

4          Permission — acrobatic flight

   (1)     The pilot in command of an aircraft may engage in acrobatic flight at a height lower than 3 000 feet over the airfield during an air display.

   (2)     The permission is subject to the conditions mentioned in Schedule 2.

5          Permission — flight over a public gathering

   (1)     The pilot in command of an aircraft may fly over a public gathering at the airfield during an air display.

   (2)     The permission is subject to the conditions mentioned in Schedule 3.

6          Permission — low flying

   (1)     The operator of an aircraft and the pilot in command may operate or fly at a height lower than 1 000 feet over a public gathering at the airfield during an air display.

   (2)     The permission is subject to the conditions mentioned in Schedule 4.

Schedule 1          Conditions for the air display approval

      1     An air display must comply with the requirements mentioned in CAO 29.4 except regulation 3 and paragraph 4.2.

      2     At least 28 days before any particular proposed air display, the RAAF Museum must provide CASA with written details of the following:

(a)   the date and place of the particular air display;

(b)   the name and contact details of the person proposed as organiser of the air display;

(c)   the program of events;

(d)   the organisations participating;

(e)   the names of the person who will be the principal participants.

      3     The RAAF Museum must receive CASA’s written consent to any particular air display before it takes place.

      4     An air display which is solely a flying exhibition within the RAAF Museum’s Interactive Flying Program need not comply with clause 2.

Note   Each air display which is not part of the RAAF Museum’s Interactive Flying Program must be the subject of a CASA safety assessment.

      5     Each operator and pilot in command must ensure that during operations their aircraft broadcasts details of its activity on the Point Cook MBZ frequency.

      6     Each operator and pilot in command must ensure that a listening watch is maintained on that frequency.

      7     Each operator and pilot in command must ensure that the aircraft complies with the manoeuvring limitations mentioned in Schedule 3.

      8     The RAAF Museum must ensure that 1 or more showlines are in place and clearly visible to assist participants to comply with the manoeuvring limitations mentioned in Schedule 3.

      9     The RAAF Museum must ensure that showlines are identified and explained to participants.

Note   A natural feature may be part of a showline provided it is identified and explained as such.

Schedule 2          Conditions for acrobatic flight

            The pilot in command must:

(a)   have a separate permission from CASA (a low level acrobatic approval) to engage in acrobatic flight at a height lower than 3 000 feet; and

(b)   comply with any height restriction in the low level acrobatic approval; and

(c)   comply with the manoeuvring limitations in Schedule 3.

Schedule 3          Conditions for flight over a public gathering

            Manoeuvring limitations

      1     If an aircraft is flying at a height below 1 500 feet above ground level, the following requirements must be complied with:

(a)   the aircraft must not track or manoeuvre towards spectators:

             (i)  for an aircraft with a maximum display speed of 100 knots or less and a maximum take-off weight of 5 700 kg or less ¾ within a horizontal distance of less than 150 metres;

            (ii)  for an aircraft with a maximum display speed of between 101 knots and 200 knots and a maximum take-off weight of 5 700 kg or less ¾ within a horizontal distance of less than 350 metres;

            (iii)  for an aircraft with a maximum display speed of 201 knots or more, or a maximum take-off weight of more than 5 700 kg — within a horizontal distance of less than 500 metres;

              (b)  the aircraft must not conduct a flypast within a horizontal distance from the spectators of less than 100 metres;

              (c)  for manoeuvres that are not tracking or manoeuvring towards spectators, the aircraft must not conduct manoeuvres:

             (i)  for an aircraft with a maximum display speed of 100 knots or less and a maximum take-off weight of 5 700 kg or less — within a horizontal distance from the spectators of less than 100 metres;

            (ii)  for an aircraft with a maximum display speed of between 101 knots and 300 knots and a maximum take-off weight of 5 700 kg or less ¾ within a horizontal distance from the spectators of less than 250 metres;

            (iii)  for an aircraft with a maximum display speed of 301 knots or more, or a maximum take-off weight of more than 5 700 kg ¾ within a horizontal distance from the spectators of less than 350 metres.

      2     In this Schedule, a flypast means that the aircraft is:

(a)   in wings level flight; and

(b)   not in close formation; and

(c)   parallel to, or moving away from, the line of the spectators; and

(d)   flying with a rate of climb or descent that is not greater than 500 feet per minute.

Schedule 4          Conditions for low flying

             The pilot in command must not fly below 200 feet above ground level unless he or she:

(a)   is taking off or landing; or

(b)   has a low level acrobatic approval which permits flight below 200 feet above ground level.
