CASA 05/21 — Number of Cabin Attendants(Regional Express) Direction 2021

1          Name

                 This instrument is CASA 05/21 — Number of Cabin Attendants (Regional Express) Direction 2021.

2          Duration

                 This instrument:

(a)   commences on the day after it is registered; and

(b)   is repealed at the earlier of the following:

             (i)  the commencement of the Civil Aviation Safety Amendment (Part 121) Regulations 2018;

            (ii)  the end of 30 November 2022.

Note   For regulation 11.250 of CASR, the directions issued in this instrument cease to be in force at the earlier of the times mentioned in paragraph (b).

3          Definitions

                 In this instrument:

cabin attendant: see subsection 2 of Civil Aviation Order 20.16.3.

Regional Express meansRegional Express Pty Ltd, ARN 752788.

relevant aircraft means a B737-800 series aircraft with a type certificate data sheet that provides for a maximum seating capacity of 189 passengers.

4          Application

                 This instrument applies to Regional Express in relation to its operation of the relevant aircraft in charter, or regular public transport, operations.

5          Directions

        (1)     Subparagraph 6.1 (b) of Civil Aviation Order 20.16.3does not apply to Regional Express.

        (2)     Regional Express must assign for duty at least 1 cabin attendant for every 50 passenger seats or part of that number fitted to the relevant aircraft.

        (3)     Regional Express must give written notice to CASA of any revision to any part of its operations manual that affects emergency procedures for the relevant aircraft, including in relation to exits or procedures relating to able-bodied passengers.

        (4)     A notice mentioned in subsection (3) must be given at least 14 days before making the proposed revision.
