3 Carriage of Dangerous Goods by Road Amendment (No. 1) No. 280, 1993 ˙ Short title 1. This regulation may be cited as the Carriage of Dangerous Goods by Road Amendment Regulation (No. 1) 1993 . ˙ Commencement 2. This regulation commences on 2 August 1993. ˙ Amended regulation 3. The Carriage of Dangerous Goods by Road Regulation 1989 is amended as set out in this regulation. ˙ Amendment of s.5 (Definitions) 4. Section 5— insert— “Code” means the Australian Code for the Transport of Dangerous Goods by Road and Rail (ADG Code) prepared by the Federal Office of Road Safety of the Commonwealth Department of Transport and Communications; ’. ˙ Amendment of s.10 (Carriage of dangerous goods) 5.(1) Section 10(1)(d)(iii)— renumber as section 10(1)(d)(v). (2) Section 10(1)(d)— insert— (iii) the driver is complying with any conditions stated on the certificate; and (iv) the driver is mentally and physically fit to drive the vehicle; and ’.
4 Carriage of Dangerous Goods by Road Amendment (No. 1) No. 280, 1993 ˙ Amendment of s.11 (Application for a certificate of authorisation) 6.(1) Section 11(2)(b)(ii) (after practitioner )— insert no more than 3 months before the application is made ’. (2) Section 11— insert— ‘(4) The chief executive may grant a certificate of authorisation subject to the conditions stated on the certificate. ’. ˙ Amendment of s.12 (Qualifications) 7.(1) Section 12(a)— omit, insert— (a) must, no more than 6 months before applying for the certificate— (i) complete, to the chief executive’s satisfaction, a course of study approved by the chief executive in relation to the carriage of dangerous goods; or (ii) satisfy the chief executive that the person has sufficient knowledge of— (A) the Code; and (B) the safe operation of vehicles carrying dangerous goods; and (C) the nature and properties of dangerous goods; and (D) the dangers associated with the type of dangerous goods proposed to be carried by the person; and (E) the emergency procedures to be taken in the event of an accident or an escape of dangerous goods from a vehicle; and (F) the use of safety equipment as specified by the Code necessary for the type of dangerous goods proposed to be carried by the person; and ’.
5 Carriage of Dangerous Goods by Road Amendment (No. 1) No. 280, 1993 ˙ Amendment of s.13 (Duration of certificate of authorisation) 8.(1) Section 13(1)(b) and (c) and (2)— omit Commissioner ’, insert chief executive ’. (2) Section 13(1)(c)(iii)— omit, insert— (iii) providing evidence of compliance with section 12; and ’. (3) Section 13(1)(c)(iv) (after practitioner )— insert no more than 3 months before the application is made ’. (4) Section 13(1)(c)(v)— omit. (5) Section 13(2)— omit, insert— ‘(2) If the chief executive approves the application for renewal, the chief executive must issue a certificate of authorisation to the applicant. ’. (6) Section 13(3)— omit, insert— ‘(3) An applicant for a certificate, or renewal of a certificate, of authorisation must give the chief executive the further information in relation to the application that is requested by the chief executive. ’. ˙ Amendment of s.14 (Surrender of certificate of authorisation) 9. Section 14— omit Commissioner ’, insert chief executive ’. ˙ Amendment of s.15 (Cancellation and suspension of certificate of authorisation) 10.(1) Section 15(1), (2)(a), (3), (4) and (5)— omit Commissioner ’, insert chief executive ’.

(3) Section 15(1)— insert— (c) no longer holds a driver’s licence; or ’. ˙ Amendment of s.16 (Licence to carry) 11.(1) Section 16(1)(b) and (c)— omit. (2) Section 16(1)(d)— omit Main Roads Act 1920–1988 ’, insert Transport Infrastructure (Roads) Act 1991 ’. (3) Section 16(2)— omit, insert— ‘(2) An applicant for a licence, or renewal of a licence, must give the chief executive the further information in relation to the application that is requested by the chief executive. ’. ˙ Amendment of s.17 (Certified copy of licence and certificate of authorisation) 12. Section 17(1)— omit Commissioner ’, insert chief executive ’. ˙ Amendment of s.18 (Amendment of licence and certificate of authorisation) 13.(1) Section 18— omit Commissioner ’, insert chief executive ’. (2) Section 18(1)(b)—
7 Carriage of Dangerous Goods by Road Amendment (No. 1) No. 280, 1993 omit, insert— (b) the licensee or holder of a certificate of authorisation wants to vary— (i) the classes of dangerous goods included in the licence or certificate of authorisation; or (ii) the conditions stated on the licence or certificate of authorisation; ’. (3) Section 18(1) (second sentence)— omit, insert— ‘(1A) The application must be accompanied by— (a) the prescribed fee; and (b) evidence of compliance in relation to the amendment; and (c) in the case of an application to vary the conditions stated on a licence or certificate of authorisation—a written statement setting out the reasons why the licensee or holder wants to vary the conditions. ’. (4) Section 18(2)— omit pursuant to subregulation (1) ’, insert under subsection (1) ’. ˙ Amendment of s.29 (Reporting of accidents) 14. Section 29(b)— omit Commissioner ’, insert chief executive ’. ˙ Insertion of new ss.29A and 29B 15. After section 29— insert— ˙ ‘False or misleading information ‘29A.(1) A person must not— (a) make a statement to an authorised officer that the person knows is
8 Carriage of Dangerous Goods by Road Amendment (No. 1) No. 280, 1993 false or misleading in a material particular; or (b) omit from a statement made to an authorised officer anything without which the statement is, to the person’s knowledge, misleading in a material particular. Maximum penalty—40 penalty units. ‘(2) A complaint against a person for an offence against this section is sufficient if it states that the statement made was false or misleading to the person’s knowledge. ˙ ‘False and misleading documents ‘29B.(1) A person must not give to an authorised officer a document containing information that the person knows is false, misleading or incomplete in a material particular. Maximum penalty—40 penalty units. (2) Subsection (1) does not apply to a person who, when giving the document— (a) informs the authorised officer of the extent to which the document is false, misleading or incomplete; and (b) gives the correct information to the authorised officer if the person has, or can reasonably obtain, the correct information. ’. ˙ Amendment of s.31 (Evidentiary provisions) 16. Section 31(a)— omit Commissioner ’, insert chief executive ’. ˙ Amendment of s.32 (Penalty notices) 17. Section 32(2)(g), (4)(b) and (5)(a)— omit Director-General ’, insert chief executive ’.
