Queensland Carers (Recognition) Amendment Act 2010 Act No. 47 of 2010 An Act to amend the Carers (Recognition) Act 2008 for particular purposes [Assented to 5 November 2010]
Carers (Recognition) Amendment Act 2010 [s 1] The Parliament of Queensland enacts— 1 Short title This Act may be cited as the Carers (Recognition) Amendment Act 2010 . 2 Commencement This Act commences on a day to be fixed by proclamation. 3 Act amended This Act amends the Carers (Recognition) Act 2008. 4 Amendment of s 5 (Definitions) Section 5, definition statutory body — omit, insert— ‘ statutory body see the FinancialAccountabilityAct2009 , section 9.’. 5 Amendment of s 6 (Meaning of carer ) (1) Section 6(2)— renumber as section 6(4). (2) Section 6— insert— ‘(2) Also, a grandparent is a carer of his or her grandchild if— (a) the child lives with the grandparent; and (b) the grandparent is the primary care-giver and decision-maker for the child. Carers (Recognition) Amendment Act 2010 [s 6] ‘(3) However, if a child’s parent or parents remain the primary care-givers and decision-makers for the child, the child’s grandparent is not the child’s carer only because— (a) the grandparent cares for the child while the child’s parent or parents are working; or (b) the child, together with the child’s parent or parents, lives with the grandparent.’. (3) Section 6(4), as renumbered, ‘However, for’— omit, insert— ‘For’. 6 Amendment of s 9 (Obligation of public authorities to consider carers charter) (1) Section 9(2)— renumber as section 9(3). (2) Section 9— insert— ‘(2) A public authority, to the extent its internal human resources policies may significantly affect an employee in carrying out the employee’s role as a carer, must ensure the policies are developed taking into consideration the principles of the carers charter.’. 7 Amendment of s 10 (Reporting obligations) Section 10(3), definition annual report — omit, insert— ‘ annual report see the FinancialAccountabilityAct2009 , schedule 3.’. 8 Amendment of s 14 (Membership) (1) Section 14(1), ‘10’— omit, insert— 2010 Act No. 47 Page 5
Carers (Recognition) Amendment Act 2010 [s 9] ‘12’. (2) Section 14(3)— omit, insert— ‘(3) Four members must be carers, one of whom must be a grandparent-carer.’. (3) Section 14— insert— ‘(5) One member must be a representative of grandparent-carers. ‘(6) In this section— grandparent-carer means a carer mentioned in section 6(2).’. 9 Amendment of schedule (The Queensland carers charter) (1) Schedule, preamble, after ‘their role as carers; and’— insert— ‘grandparents who are carers for their grandchildren make a significant contribution to the lives of their grandchildren and deserve respect and support for their role as carers; and’. (2) Schedule, items 10 and 11— renumber as items 12 and 13. (3) Schedule— insert— ‘10 Grandparents who are carers for their grandchildren, after having raised their own children, should be supported in their important and challenging role. 11 Grandparents who are carers for their grandchildren need easy access to information that is clear and relevant to their role as a carer.’. © State of Queensland 2010 Page 6 2010 Act No. 47
