Careless Use of Fire Act 1954 (ACT)

AN ORDINANCE

To amend the Careless Use of Fire Ordinance 1936-1952.

Executive Council, in pursuance of the powers conferred by the BE it ordained by the Governor-General in and over the Com-monwealth of Australia, with the advice of the Federal	Seat of Government Acceptance Act 1909-1938 and the Seat of
Government (Administration) Act 1910-1947, as follows:—

1.— (1.) This Ordinance may be cited as the Careless Use of short title

Fire Ordinance 1954.* and citation.

(2.) The Careless Use of Fire Ordinance 1936-1952 is in this

Ordinance referred to as the Principal Ordinance.

(3.) The Principal Ordinance, as amended by this Ordinance,

may be cited as the Careless.Use of Fire Ordinance 1936-1954.

2. Section three of the Principal Ordinance is amended— Definitions.

(a) by inserting before the definition of " Chief Fire Control

Officer " the following definition :—

" ' built-up area ' means an area in the Territory declared by the Minister by notice in the Gazette to be a built-up area; " ;

(b) by omitting the definition of " City Area " ; and

(c) by inserting after the definition of "Owner" the

following definition:—

" ' prescribed period ' means—

(a) a period commencing on the first day of January in a year and extending to the last day of February in that year or to such other day in that year as the Council (by notice in the Gazette and in a newspaper circulating in the Territory) determines; or

(&) a period commencing on the first day of November in a year, or on such other day in that year as the Council (by notice in the Gazette and in a news- paper circulating in the Territory) determines, and extending to the last day of December in that year;" .

the Council.	3. Section five H of the Principal Ordinance is amended by omitting from sub-section (1.) the words "other than the City Area " and inserting in their stead the words " other than a part which is a built-up area ".
Tire Districts.	4. Section five L of the Principal Ordinance is amended by omitting the words " outside the City Area " and inserting in their stead the words " other than a part of the Territory which is a built-up area ".

Control	(a) by omitting from sub-section (1.) the words "other than the City Area " and inserting in their stead the words " other than a fire which is in a built-up area or a building and at which an officer of the Canberra Fire Brigade is in attendance " ; and

(b) by adding at the end of sub-section (2.) the words "or by the Fire Controller or Deputy Fire Controller for any other District".
Lighting	6. Section ten of the Principal Ordinance is amended—

purposes.	(a) by omitting from paragraph (a) of sub-section (1.) the words " the City Area" and inserting in their stead the words " a built-up area " ;
(b) by omitting from sub-paragraph (i) of paragraph (a) of sub-section (1.) the words " during the period com- mencing on the first day of March and ending on the thirty-first day of October in any year " and inserting in their stead the wrords " during any period that is

not a prescribed period " ;

(c) by omitting from sub-paragraph (ii) of paragraph (a)
of sub-section (1.) the words " during any other

period" and inserting in their stead the words

" during a prescribed period " ;

(d) by omitting from paragraph (b) of sub-section (1.) the words " the City Area " and inserting in their stead the words " a built-up area " ;

(e) by omitting from sub-paragraph (i) of paragraph (b) of sub-section (1.) the words "during the period commencing on the first day of March and ending on the thirty-first day of October in any year " and inserting in their stead the words "during any period that is not a prescribed period " ; and

(/) by omitting from sub-paragraph (ii) of paragraph (&) of sub-section (1.) the words "during the period commencing on the first day of November in any year and ending on the last dav of February in the

following year and during any other period in any year which the Council specifies by notice in the Gazette and in a newspaper circulating in the Terri- tory " and inserting in their stead the words " during a prescribed period ".

7. Section ten A of the Principal Ordinance is amended—	Fins to be

(a) by omitting the words " the period commencing on the first day of November in any year and ending on the last day of February in the following year" and inserting in their stead the words " a prescribed period " ; and

(b) by omitting the words " the City Area" and inserting

in their stead the words " a built-up area ".
