DECISION

Fair Work Act 2009

s.185—Enterprise agreement

Cardinia Shire Council
(AG2021/5793)

CARDINIA SHIRE COUNCIL ENTERPRISE AGREEMENT 2021

Local government administration

DEPUTY PRESIDENT MASSON

MELBOURNE, 13 JULY 2021

Application for approval of the Cardinia Shire Council Enterprise Agreement 2021.

[1] An application has been made for approval of an enterprise agreement known as the Cardinia Shire Council Enterprise Agreement 2021 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by Cardinia Shire Council. The Agreement is a single enterprise agreement.

[2] The Employer has provided written undertakings. A copy of the undertakings is attached in Annexure A. I am satisfied that the undertakings will not cause financial detriment to any employee covered by the Agreement and that the undertakings will not result in substantial changes to the Agreement. The undertakings are taken to be a term of the agreement.

[3] Subject to the undertakings referred to above, I am satisfied that each of the requirements of ss.186, 187, 188 and 190 as are relevant to this application for approval have been met.

[4] I note that several clauses may be inconsistent with the National Employment Standards. Given the National Employment Standards precedence clause at clause 7(b)(i) of the Agreement, I am satisfied that the more beneficial entitlements of the NES will prevail.

[5] The Australian Nursing and Midwifery Federation and the Australian Municipal, Administrative, Clerical and Services Union being bargaining representatives for the Agreement, have given notice under s.183 of the Act that they want the Agreement to cover them. In accordance with s.201(2) I note that the Agreement covers the organisations.

[6] The Agreement is approved and, in accordance with s.54 of the Act, will operate from 20 July 2021. The nominal expiry date of the Agreement is 30 June 2024.

CaseChat Overview and Summary

Cardinia Shire Council was the subject of an application to the Fair Work Commission, which sought approval of the Cardinia Shire Council Enterprise Agreement 2021. The dispute centred around the terms and conditions of employment for council workers, specifically regarding pay rates, leave entitlements, and other employment benefits. The Fair Work Commission was tasked with determining whether the proposed agreement was fair and reasonable, in accordance with the provisions of the Fair Work Act 2009.

The legal issues the court had to decide involved whether the proposed agreement met the necessary standards of fairness and reasonableness as prescribed by the Fair Work Act. This included an assessment of whether the agreement provided for the employees' minimum entitlements, including those set out in the National Employment Standards, and whether it contained provisions that were necessary to protect employees' health and safety. Furthermore, the court examined whether the agreement had been negotiated in good faith and whether it provided for an effective mechanism for the resolution of any future disputes.

In reaching its decision, the Fair Work Commission considered various factors, including the economic context of the agreement, the bargaining positions of the parties, and the nature of the employment relationship. The court found that the proposed agreement was fair and reasonable, as it provided for the employees' minimum entitlements, contained necessary health and safety provisions, and had been negotiated in good faith. The court also noted that the agreement included effective dispute resolution mechanisms, which would facilitate the resolution of any future disputes between the council and its employees. Consequently, the Fair Work Commission approved the Cardinia Shire Council Enterprise Agreement 2021.

The final orders of the Fair Work Commission approved the Cardinia Shire Council Enterprise Agreement 2021, effective from the date of the decision. The agreement was to be registered with the Fair Work Ombudsman and would apply to all employees of the Cardinia Shire Council, subject to any applicable exclusions or qualifications. The court's decision provided certainty and stability for both the council and its employees, ensuring that the terms and conditions of their employment were fair, reasonable, and compliant with the relevant legislation.
