1Name

This instrument is the Carbon Credits (Carbon Farming Initiative) Amendment (Specified Tree Planting) Rule 2023.

2Commencement

1. (1)

   Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3Authority

This instrument is made under section 308 of the Carbon Credits (Carbon Farming Initiative) Act 2011.

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1Amendments commencing on the day after registration

Carbon Credits (Carbon Farming Initiative) Rule 2015

Subsection 20AB(1)

Omit “subsections (2) to (6)”, substitute “subsections (1A) to (6)”.

After subsection 20AB(1)

Insert:

1. (1A)

   Specified tree planting is not an excluded offsets project if the application for a section 27 declaration in relation to the project includes the following:

   1. (a)

      a statement to the effect that the crediting period for the project should begin on or after 1 June 2024;

   2. (b)

      an undertaking that, if the project is declared as an eligible offsets project, the day the crediting period begins will not be varied to a day that is before 1 June 2024.
