  1. The applicant requires an extension of time within which to seek special leave to appeal from a judgment of the Court of Appeal of the Supreme Court of Western Australia (Quinlan CJ, Mitchell JA and Seaward J), dismissing the applicant's appeal from a decision of the Supreme Court of Western Australia (Allanson J).

  2. The proposed appeal does not raise a question of law of general importance sufficient to warrant the grant of special leave to appeal. It concerns the construction of bespoke documents. Accordingly, it would be futile to grant the extension of time that is required.

  3. Special leave to appeal is refused with costs.
