CaseChat Overview and Summary
The Commission noted that the agreement had been negotiated in good faith and involved a majority of employees. It also found that the agreement did not lead to the detriment of employees by reducing their overall pay and conditions. The Commission considered that the agreement provided for a fair and efficient workplace, with appropriate dispute resolution processes. It concluded that the agreement met the criteria for approval under the Fair Work Act.
Accordingly, the Commission approved the Canyon Offshore Inc Remotely Operated Vehicle (ROV), Trenching & Geotechnical Enterprise Agreement 2015. The agreement would now apply to the relevant employees and employers. The approval was subject to the usual conditions, including the requirement to provide a copy of the agreement to the Fair Work Ombudsman.
