bury certain land at the corner of Bazentin Street and Persic Street, Belfield, having an area of 16f perches, being the land marked as "Recreation Reserve" on Deposited Plan 12859 and being the land comprised in Certificate of Title

Volume 3989 Folio 19, in consideration of the said Council entering into a certain covenant as to the purposes for which the land could be used : AND WHEREAS the said land became vested in the said Council in fee simple subject only to the said covenant: AND WHEREAS the said Council has since held and used the said land for the purpose of providing a recreation reserve, being one of the purposes permitted under the terms of the said covenant : AND WHEREAS there is vested in certain persons as Trustees for the Belfield Sub-Branch of the Returned Services League of Australia (New South Wales Branch) Incorporated (hereinafter referred to as "the Sub-Branch") certain land being Lot 16 of Section D on Deposited Plan 12859, being the land comprised in Certificate of Title Volume 5632 Folio 221 and Lot 1 on Deposited Plan 519227, being the land comprised in Certificate of Title Volume 10301 Folio 70 : AND WHEREAS there is vested in the same persons as Trustees for the Sub-Branch certain other land fronting Persic Street Belfield adjoining the said land in Certificate of Title Volume 3989 Folio 19 being Lot 18 of Section D on Deposited Plan 12859 and being the land comprised in Certificate of Title Volume 3676 Folio 238 : AND WHEREAS the Sub-Branch has constructed certain improvements on the said Lot 18 and wishes to extend its improvements to the said land adjoining being the said land in Certificate of Title Volume 3989 Folio 19 : AND WHEREAS the Sub-Branch is willing to transfer to the said Council part of the said Lot 16 on Deposited Plan 12859 and Lot 1 on Deposited Plan 519227, being so much thereof as shall have an area of 17 perches and be of the dimensions bearings as set out in the Second

authority under the Local Government Act, 1919, as Schedule hereto : AND WHEREAS the said Council has no

amended by subsequent Acts, to sell or exchange any part of a public reserve: AND WHEREAS it is expedient to authorise the said Council to convey and transfer the said land in Certificate of Title Volume 3989 Folio 19 to the Sub-Branch in exchange for so much of the said Lot 16 on Deposited Plan 12859 and Lot 1 on Deposited Plan 519227 as shall have an area of 17 perches and shall have such dimensions as set out in the Second Schedule hereto :

AND WHEREAS the Sub-Branch is willing to transfer so much of the said Lot 16 on Deposited Plan 12859 and Lot 1 on Deposited Plan 519227 as shall have an area of 17 perches and be of such dimensions as set out in the Second Schedule hereto in exchange for the said land in Certificate of Title Volume 3989 Folio 19 : Be it therefore enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legis- lative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—

This Act may be cited as the "Canterbury Municipality (Bazentin and Persic Streets Recreation Reserve) Act, 1968".

2. The Council of the Municipality of Canterbury is hereby authorised and empowered to convey and transfer the lands described in the First Schedule hereto in fee simple freed and discharged from all trusts estates or interests affect- ing the same to Trustees for the Belfield Sub-Branch of the Returned Services League of Australia (New South Wales Branch) Incorporated subject to the said Trustees for the Belfield Sub-Branch of the Returned Services League of Australia (New South Wales Branch) Incorporated trans- ferring to the said Council of the Municipality of Canter- bury in fee simple freed and discharged from all trusts estates or interests the lands described in the Second Schedule hereto.

3. The Registrar-General, upon the relevant transfers being lodged for registration and subject to the payment of the prescribed fees, shall issue to the Council of the Muni- cipality of Canterbury a Certificate of Title to the lands described in the Second Schedule hereto, to be held by such Council as a public reserve within the meaning of the Local Government Act, 1919, as amended, and to the said Trustees a Certificate of Title to the lands described in the First Schedule hereto, freed and discharged from all trusts affecting the same.

FIRST SCHEDULE.

ALL THAT piece of land situate in the Municipality of Canter- bury Parish of St. George and County of Cumberland having an area of 16J perches being the land marked as "Recreation Reserve" on Deposited Plan 12859 and being the whole of the land comprised in Certificate of Title Volume 3989 Folio 19.

SECOND SCHEDULE.

ALL THAT piece of land in the Municipality of Canterbury Parish of St. George and County of Cumberland commencing at a point on the northern side of Bazentin Street bearing 84° 29' 0" and distant 105 feet from its intersection with the north-eastern side of Boronia Street and bounded thence on the south-east by a line in a north-westerly direction bearing 354° 29' 50" 127 feet being part of the north-eastern boundary of Lot 15 Section D in Deposited Plan 12859 and bounded thence on the north-east by a line in a south-easterly direction bearing 144° 19' 10" 146 feet 101 inches to the northern side of Bazentin Street thence by part of that street being a line in a south-westerly direction bearing 264° 29' 0" 73 feet 10i inches to the point of commencement and containing by admeasurement 17 perches and comprising part of Lot 16 of Section D in Deposited Plan 12859 (being the land in Certificate of Title Volume 2632 Folio 221) and part of Lot 1 in Deposited Plan 519227 (being the land in Certificate of Title Volume 10301 Folio 70).
