AN ACT to render unlawful the use of portion of

Canning Location 37 as a sanitary site.

[Assented to 24th January, 1947.]

RE it enacted by the King's Most Excellent Majesty,

by and with the advice and consent of the Legis-

lative Council and Legislative Assembly of Western

Australia, in this present Parliament assembled, and by

the authority of the same, as follows :—

Short title.

1.

This Act may be cited as the Calming District

Sanitary Site Act, 1946.

Notwithstanding the provisions of the Health Act,

authority of or pursuant to such Act, it shall be unlawful on and after the first day of January, one thousand nine hundred and fifty, for any person to use or con- tinue to use the land specified in the Schedule hereto or any part thereof for the purpose of the reception, utilisa- tion or deposit of nightsoil, refuse matter or rubbish.

Penalties.

Any person who on or after the date aforesaid uses or continues to use the said land or any part thereof for the purpose aforesaid shall be guilty of an offence against this Act and shall be liable to a penalty not exceeding fifty pounds and to a daily penalty not exceeding five pounds.

Minimum

penalty.

4. Notwithstanding anything contained in the Jus- tices Act, 1902-1942, the minimum pecuniary penalty for an offence against this Act shall be one-tenth of the maximum penalty prescribed.

Prosecutions.

5. Proceedings in respect of offences under this Act

may be commenced, heard and determined summarily

under and in accordance with the provisions of the

Justices Act, 1902-1942.

6. The administration of this Act shall be under the

provisions of the Health Act, 1911-1944.

THE SCHEDULE.

All that piece of land being portion of Canning Location 37 and being Lot 25 on L.T.O. Plan 3383 (Certificate of Title Volume 777, Folio 192) containing 75 acres 1 rood 30 perches or thereabouts.
