REGULATIONS UNDER THE CANNED FRUITS EXPORT CONTROL ACT 1926-1930.

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Canned Fruits Export Control Act 1926-1930, to come into operation as from 1st December, 1930.

Canned Fruits Export Control (Staff) Regulations.

Short title.

1. These Regulations may be cited as the Canned Fruits Export Control (Staff) Regulations.

Definitions.

2. In these Regulations, unless the contrary intention appears—

“officer” means an officer appointed under the Act;

“the Act “means the Canned Fruits Export Control Act 1926-1930;

“the Secretary” means the Secretary to the Board.

Salaries of officers.

3. The limits of salaries of officers shall be in accordance with Tables A and B in the Schedule to these Regulations.

Increments.

4. Such increments shall be paid to officers as the Board determines, but not in any case beyond the maximum of the limits of salary fixed in respect of his office.

Employment subject to good behavior

5. All officers shall hold office, during the pleasure of the Board, subject to good behavior and compliance with these Regulations.

Office hours.

6.—(1.) Except where otherwise determined by the Board, the hours of attendance to be observed by officers shall, subject to these Regulations, be from 9 a.m. to 5 p.m., with an interval of one hour for luncheon, except on Saturdays, when the hours of attendance shall be from 9 a.m. to 12 noon.

(2.) Where the nature of the duties of any officer does not permit of attendance as prescribed in the last preceding sub-regulation, the hours of duty of that officer shall be determined by the Board.

Duty after office hours.

7. The Secretary may, whenever necessary, require officers to perform work after the usual office hours.

Overtime.

8.—(1.) The Secretary, if satisfied as to the necessity therefor, may sanction the working of overtime.

(2.) Overtime shall be recorded and paid to officers subject to and in accordance with the provisions of these Regulations.

(3.) The hourly rate of overtime, based on time and a half, shall be calculated in accordance with the following formula:—

(4.) The minimum rate of payment for overtime shall be one shilling per hour, and overtime shall be calculated to the nearest quarter of an hour of the total amount of time to be claimed.

(5.) Officers in receipt of a salary exceeding £450 per annum shall not be entitled to receive overtime payment.

(6.) Payment of overtime shall be calculated on the basis of all time worked in excess of 44 hours per week.

Meal allowance.

9. Where an officer is required to remain on duty after 6 p.m., and such attendance necessitates his obtaining a meal away from home, he shall be granted a meal allowance of three shillings.

Absence from duty during office hours.

10.—(1.) Except by express permission of the Secretary, an officer shall not be allowed to leave his office during office hours.

(2.) At the discretion of the Secretary leave for such absence may be granted with or without pay.

Recreation leave.

11. The Board may grant recreation leave to officers on the completion of each period of twelve months’ employment for any period or periods not being, in the aggregate, less than twelve working days, nor more than eighteen working days in any such period of twelve months.

Absence from duty in case of illness or emergency.

12.— (1.) If an officer is prevented by illness or other emergency from attending his duty, he shall immediately report the fact to the Secretary.

(2.) On production of satisfactory evidence as to illness, an officer may he granted leave of absence with pay for such period as the Board determines.

(3.) Where sick leave is granted on account of illness without the production of evidence satisfactory to the Board, such leave shall be without pay.

Rate of travelling allowances.

13. Officers shall be paid travelling allowances in accordance with Table C in the Schedule to these Regulations.

Secretary to report to Board as to certain matters.

14. The Secretary shall report to the Board, whenever the necessity arises, any alterations which are, in his opinion, necessary or expedient for the more economical, efficient and convenient working of his office, and any alterations which are in his opinion necessary in the salaries or allowances of any of the officers under his control; and shall bring under the notice of the Board any matter in relation to any officer, or to the work of his office, with which he thinks it desirable that the Board should be acquainted.

 

Officers in London.

15. For the purpose of the application of these Regulations to officers in London, the powers and functions conferred by these Regulations on the Board or the Secretary may, subject to any resolution of the Board, be exercised by the Overseas Representative of the Board.

Salaries and allowances to be subject to Financial Emergency Acts.

16. The salaries and allowances prescribed by these Regulations shall be subject to reduction by or under the Financial Emergency Acts 1931 in the same manner as they would have been so subject had the Regulations been in force at the time of the commencement of that Act.
