CANCER COUNCIL OF WESTERN AUSTRALIA.

No. 24 of 1980.

AN ACT to amend the Cancer Council of Western

Australia Act 1958-1964.

[Assented to 17 October 1980.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent

of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Cancer

Short title

and citation.

Council of Western Australia Amendment Act 1980.

In this Act the Cancer Council of Western

Australia Act 1958-1964 is referred to as the principal

Act.

The principal Act as amended by this Act

may be cited as the Cancer Council of Western

Australia Act 1958-1980.

2. This Act shall come into operation on a day

to be fixed by proclamation.

Sections

amended and

3. (1) Section 6 of the principal Act is

transitional amended

provision.

(a) in subsection (3)-

(i)  by deleting "ten" and substituting the following-

" seven "; and

(ii)   by deleting paragraphs (a) to (g) and substituting the following paragraphs-

" (a) one shall be nominated by

the controlling body of each

of the following hospitals-

(i) Royal Perth Hospital;

(ii)

Sir Charles Gairdner

Hospital;

(iii) Fremantle Hospital;

(iv)

King Edward Mem-

orial Hospital; and

(v) Princess

Margaret

Hospital; and

(b)

two shall be nominated by the Senate of The University of Western Australia, one of whom shall be medically qualified. ";

(b)

by deleting subsection (6) and substituting the following subsection-

" (6) The Minister shall recommend to the Governor for appointment as members of the Council the following persons who are willing to accept office as members of the Council-

(a)

two persons who are selected by the Minister one of whom shall be medically qualified; and

(b)

five persons who are nominated in accordance with subsection (8) of this section,

and the Governor shall appoint the persons so recommended as members of the Council. " ;

(c) in subsection (7)-

(i)  by inserting after "Council" in paragraph (a) the following-

" after the coming into operation of the Cancer Council of Western Australia Amendment Act 1980 ";

(ii)  by deleting paragraph (c) and substituting the following paragraph-

" (c) The President and Deputy President of the Council shall be elected for the period specified in their appointments as members of the Council. ";

(iii)  by deleting "for the unexpired portion of the term of the President or Deputy President of the Council in whose place he is elected" from paragraph (e); and

(iv) by deleting paragraph (f);

(d) in subsection (8)-

(i) by deleting paragraph (a) and substituting the following para- graph

" (a) At a meeting constituted of members appointed pursuant to subsections (3), (4) and (5) and

paragraph (a) of subsection (6) of this section and at any meeting of the Council thereafter those members present shall nominate additional persons to the number of five being persons willing to accept office as members of the Council and to be nominated as nominees of the Council. ";

(ii)

by deleting "Council" in paragraph

(b) and inserting the following-

" meeting "; and

(iii)  by deleting paragraph (d) and substituting the following para- graph

" (d) If the meeting does not furnish the names of five persons as it is required to do by this subsection, the Minister shall inform the Governor who shall appoint five persons as he thinks fit to be members of the Council. ";

(e)

in subsection (10) by deleting paragraph (a) and substituting the following paragraph-

" (a) A member of the Council shall hold office for such period not exceeding 3 years as may be specified in his instrument of appointment. "; and

(f)

in subsection (12) by deleting paragraph (a) and substituting the following paragraph-

" (a) Where a vacancy occurs in the office of a member, the vacancy shall be filled in the manner in which the appointment to the vacant office was originally made. " .

(2) A person holding office as a member of the Cancer Council of Western Australia immediately before the coming into operation of this Act shall by virtue of the coming into operation of this Act, vacate that office but, subject to the principal Act as amended by this Act, such a person shall be eligible for re-appointment as a member of that Council.

Section 8

Section 8 of the principal Act is amended in

subsection (2) by inserting after paragraph (e) the

following paragraph-

amended.

" (ea) to provide and maintain services for patients undergoing treatment for cancer; " .

Section 9

5.

Section 9 of the principal Act is amended in

subsection (2) by deleting paragraph (b) and

substituting the following

amended.

'C (b) appoint as chairman of a Committee,

any one of the Committee's

members. " .

Section 22

6.

Section 22 of the principal Act is amended in

subsection (2) by deleting "thirtieth day of June"

and substituting the following-

amended.

" thirty-first day of December "
