Canberra Public Cemeteries Regulations 2 (Amendment)

I, WILLIAM MICHAEL HODGMAN, the Minister of State for the Capital Territory, hereby make the following Regulations under the Cemeteries Ordinance 1933.

Fees and charges

1. Regulation 6 of the Canberra Public Cemeteries Regulations is amended

by adding at the end thereof the following sub-regulation:

"(7) Where—

(a)

a person pays a fee or charge prescribed in Schedule 2 in respect of a burial specified in item 5 (b), 5 (c), 6 (b), 6 (c) or 6 (d) of Part II of that Schedule or an interment cf ashes specified in item 8 (b), 8 (c) or 8 (d) of Part II of that Schedule; and

(b)

a headstone is erected on the allotment in which that burial or inter­ ment took place within 2 years after the date of that burial or inter­ ment, as the case may be,

after the date on which it was so granted but may, upon application made by unless it is sooner surrendered, expire on the expiration of a period of 25 years

the Trustees shall, on application by the person referred to in paragraph (a),

refund to the person the sum of $70.".

2. After regulation 15 of the Canberra Public Cemeteries Regulations the

following regulation is inserted:

Duration of exclusive rights in Gungahlin Cemetery

"15A . (1) An exclusive right of burial granted under regulation 15 in any

specified allotment in the public cemetery known as Gungahlin Cemetery shall,

the holder of the right in accordance with this regulation, be renewed for a period of 25 years from the date of expiration of the right or of the last period of renewal, as the case may be.

"(2) An application for renewal of an exclusive right of burial shall be in writing and lodged with the Secretary together with the prescribed fee before the date of expiration of the right or of the last period of renewal.

"(3) Where an exclusive right of burial has been renewed under this regulation, the Secretary shall—

(a)

note particulars of the renewal on the certificate issued to the holder of the right in pursuance of sub-regulation 15 (3); and

(b) enter those particulars in the register referred to in regulation 16.".

Schedule 2

3. Schedule 2 to the Canberra Public Cemeteries Regulations is repealed and the following Schedule substituted:

PART 1

FEES AND CHARGES—WODEN CEMETERY

1. Certificate issued under sub-regulation 15 (3) of exclusive right of burial . . . . 55.00
2. Duplicate issued under sub-regulation 15 (6) of certificate of exclusive right of burial. 0.75
3. Copy of entry in register furnished under sub-regulation 17 (2) 0.50
4. Burial, in a grave excavated to a depth not exceeding 1.50 metres of—
(a) a person of 4 years of age or more on—
(i) a Saturday, Sunday or holiday 155.00

Burial, in a grave excavated to a depth of 1.80 metres—the fee that would be payable if the burial were in a grave excavated to a depth not exceeding 1.50 metres plus an additional fee of

7. Exhumation and reburial in same allotment (not including removal and replacement
of any memorial or other improvement to an allotment) 160.00
8. Exhumation and reburial in another allotment in the Woden Cemetery (not including
removal and replacement of any memorial or other improvement to an allotment) 200 00

9.             Exhumation for removal of body to another cemetery (not including removal and

replacement of any memorial or other improvement to an allotment) 120.00

10.             Application under sub-regulation 26 (1)—

(a) for permission to erect kerbing or railing only 1.50
(b) for permission to erect on an allotment a monument, tablet, gravestone or other
structure, together with any kerbing or railing to be erected at the same time 10.00
(c) for permission to erect on an allotment a vault 10.00
(d) for permission to erect on an allotment a memorial 15.00
(e) for permission to erect, other than on an allotment, a monument or other structure 7.50
11. Supplying, inscribing and fixing a tablet in a lawn burial area 30.00

Application

4. (1) The Canberra Public Cemeteries Regulations, as amended by these Regulations, do not apply in relation to an exclusive right of burial in any allot­ ment in the public cemetery known as Gungahlin Cemetery that was granted before the commencement of these Regulations.

(2) The Canberra Public Cemeteries Regulations, as in force immediately before the commencement of these Regulations, continue to apply in relation to an exclusive right of burial in any allotment in the public cemetery known as Gungahlin Cemetery that was granted before the commencement of these Regulations.
